MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES, HELD IN THE
COUNCIL CHAMBERS, CIVIC CENTER,
MONDAY, October 3, 1977
CALL TO ORDER: The regular meeting of the City Council of the City of Des
Plaines was called to order by Mayor Herbert H. Volberding
at 8:05 P.M. in the Council Chambers, Des Plaines Civic
Center.
III ROLL CALL:
Roll Call indicated the following Aldermen present;
Koplos, Szabo, Sullivan, Ensign, Leer, Brannigan, Kisslinger,
Birchfield, Erbach, Kraves, Sarlo, Meyer, Seitz, Abrams,
Ward. Absent was Alderman Kehe, who arrived later.
Also present were: City Comptroller Blietz, Commissioner of Public Works
Schwab, City Engineer Bowen, Acting Building Commissioner Trost, Deputy
Fire Chief Clark, Police Captain Mensching, Health Director Branding,
Environmental Officer Lindahl, and City Attorney Hug.
PRAYER AND The meeting opened with prayer by Rev. James Bauman, pastor
PLEDGE of Immanuel Lutheran Church, followed by the Pledge of
Allegiance to the flag.

Moved by Erbach, seconded by Sarlo, to approve the Minutes
of the meeting held September 19, 1977, as published.
Motion declared carried.
BILLS Moved by Ward, seconded by Sarlo, to adopt the following
PAYABLE resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE
AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED
TO MAKE PAYMENT FOR SAME: Total, $366,258.60.

& DOG TAGS of Finance and Insurance Committee to increase the cost
of Metal Plates and dog tags from the Rydin Sign & Decal
Company, by $100 as requested by the Company due to error
in their quotation. Upon roll call, the vote was:

INSURANCE Alderman Ward reported that the Finance and Insurance
Committee is considering the possibility of accepting a
proposal from Northwest Municipal Conference, in the amount
of $3,000 to conduct a feasibility study of self- insurance
for member municipalities for medical insurance for employees.
FIRE RESCUE Moved by Seitz, seconded by Leer, to adopt the recommendation
TRUCK of Fire and Civil Defense Committee to award the bid for
Crash Rescue Truck to Sondag Chevrolet, Inc., in the amount
of $14,224.00. Upon roll call, the vote was:
AYES: - 16 - Koplos, Szabo, Sullivan, Ensign, Leer,
Brannigan, Kisslinger, Birchfield, Erbach,

NATIONAL Moved by Seitz, seconded by Sarlo, to adopt the recommendation
FIRE CODE of Fire and Civil Defense Committee that the City Council
adopt by reference the National Electrical Code, except for
that part of the National Electrical Code which is in
conflict with the Chicago Electrical Code, City Attorney
to draft necessary ordinance. Motion declared carried.

Moved by Sarlo, seconded by Koplos, to adopt the recommendation
of Streets and Traffic Committee to reduce the speed limit
on Mason Lane to 20 MPH and to restrict parking to within
30 feet of both Busse Highway and Dempster Street, City
Attorney to draft necessary ordinance. Motion declared
carried.
TRAFFIC Moved by Sarlo, seconded by Meyer, to adopt the recommendation
CONTROLS of Streets and Traffic Committee to authorize City Clerk
Pearson & to advertise for bids per City Engineer's specifications
Ellinwood for Uniform Traffic Control signals at the intersection
of Pearson and Ellinwood, returnable October 21 at 3 P.M.

Prairie Ave. Resolution appropriating $261.23 MFT Funds for the purchase

right-of-way acquisition. Upon roll call, the vote was:

NO LEFT TURN Alderman Szabo's request for "No Left Turn on Red" signs to
ON RED be installed at the intersection of Jefferson and Graceland
for traffic on Jefferson turning south onto Graceland was
referred to Traffic Commission, Streets and Traffic Committee,
and Mayor was requested to install signs by Police Order,
City Engineer to contact State Highway Department.
NO RTGHT_TIiRN Alderman Sullivan's request to renew request for"No Right
ALGONQUIN & Turn on Red" signs at the intersection of Algonquin Rd.
RIVER RD. and River Road for traffic on Algonquin Road was referred
to Traffic Commission, Streets and Traffic Committee and
Engireering Department.
POLICE DEPT. Moved by Kehe, seconded by Sarlo, to adopt the recommendation
SQUAD CARS of Police Committee to award the bid for eight squad cars
to Des Plaines Chrysler Plymouth, in the amount of $30,272.00
net. Upon roll call, the vote was:

Moved by Koplos, seconded by Sarlo, to adopt the recommendation
of Water and Sewer Committee to authorize City Attorney
to draft necessary ordinance amdnement deleting the last
sentence of Section 3-4-4 as follows: "The work of laying
the lead and making the tap shall be done by City Employees."
Motion declared carried.
Moved by Koplos, seconded by Sarlo, to adopt the recommendation
of Water and Sewer Committee that the City Attorney be
authorized to prepare the necessary ordinance pertaining
to sewer permits and sewer installations as requested by
Commissioner of Public Works Schwab, for City Council's
further consideration. Motion declared carried.
Moved by Szabo, seconded by Koplos, to adopt the recommendation
of Municipal Development Committee that the City annex
property located at River -Central Roads, owned by the Sisters
of Our Lady of Mt. Carmel, and authorize City Attorney to
prepare necessary legal documents. Motion declared carried.
Moved by Szabo, seconded by Koplos, to adopt the recommendation
of Municipal Development Committee concurring with Zoning
Board of Appeals in Case 77-47-R, property located at River
and Central Roads, rezoning property upon annexation to
Institutional "I" District with the provision that it remain
"I" District so long as the Sisters of Our Lady of Mount
Carmel use and occupy the property and should petitioner
cease its present use, the property shall revert to R-2
Single Family Zoning unless City Council approval to rezone
is obtained, City Attorney to draft necessary ordinance.

Moved by Szabo, seconded by Erbach, to adopt the recommendation
of Municipal Development Committee, •to approve Plat of
Butler Paper Company's Des Plaines Subdivision #1, located
at 2392 S. Wolf Road, and authorize Mayor and City Clerk
to execute the Plat. Motion declared carried.
Moved by Szabo, seconded by Erbach, to adopt the recommendation
of Municipal Development Committee to approve Plat of Dedica-
tion of a 33' x 100' foot strip of Westfield Lane, and
authorize Mayor and City Clerk to sign the plat. Motion
declared carried.
Moved by Szabo, seconded by Meyer, to adopt the recommendation
of Municipal Development Committee, to approve the Plat of
Helen and Gene's Resubdivision of Homeland Acres, located
at 1481 Oxford Road and authorize Mayor and City Clerk to
sign the plat. Motion declared carried.
Moved by Szabo, seconded by Ensign, to adopt the recommendation
of Municipal Development Committee to concur with Plan
Commission in Case 2-77, to grant Variance to the Flood Plain
Ordinance at 787 Pearson Street, Des Plaines Historical
Society, and authorize City Attorney to draft necessary
ordinance. Motion declared carried.
At this time Alderman Leer and Mayor Volberding presented
Des Plaines Police Boys Club, represented by Sgt. Kenneth
Fredricks and Secretary -Treasurer 0. D. Swanson, with a
check in the amount of $1,000, proceeds from the Des Plaines
City Officials Golf Outing.
Moved by Ensign, seconded by Sarlo, to adopt the recommendation
of Library and Historical Society Committee to authorize
City Clerk to advertise for bids returnable October 14, 1977
at 3 p.m. for the moving of the Kinder House (Historical
Museum) to 787 Pearson Street. Moved by Koplos, seconded by
Abrams, to defer action. Motion withdrawn. Moved by Ensign,
seconded by Koplos, to advertise for bids returnable October
21, 1977, at 3 P.M. Motion declared carried. Alderman Ensign
voted No.

of Library and Historical Society to authorize City Attorney
to prepare a resolution recognizing the 70th anniversary
of Des Plaines Public Library, Wednesday, October 5, 1977.
Motion declared carried.
Moved by Erbach, seconded by Kisslinger, to adopt the recom-
mendation of Public Buildings, Grounds and Parking Lots
Committee to authorize City Enginneer to draw specifications
for resurfacing the apparatus room at Fire Station #2, City
Clerk authorized to advertise for bids returnable October 13,
1977 at 3 P.M., City Engineer and Public Works Department
to determine suitable way of patching driveways at Fire
Stations 2 and 3. Motion declared carried.
Moved by Erbach, seconded by Seitz, to adopt the recommendation
of Public Buildings, Grounds and Parking Lots Committee
to authorize City Clerk to advertise for bids returnable
October 21, 1977 at 3 p.m. for various items to correct
fire code violations in Des Plaines Civic Center - City Hall
Building, per recommendations of Fire Prevention Bureau and
Holmes and Fox Architects. Motion declared carried.
Alderman Sarlo's request for cushioning of seating in the
City Council Chambers was referred to Public Buildings,
Grounds and Parking Lots Committee.
Moved by Abrams, seconded by Meyer, to adopt the recommenda-
tion of City Code and Judiciary Committee to authorize R. L.
Kautz & Co. to settle the Liability Claim of Diana Cline
for the amount of $737.14. Upon roll call, the vote was:

Moved by Abrams, seconded by Kisslinger, to adopt the
recommendation of City Code and Judiciary Committee that
City Council approve the findings of said committee relative
to Robert J. DiLeonardi, Corporation Counsel, stating that
his reputation has been exemplary and matters in which he
was involved had little relevance with respect to his
activities in the City of Des Plaines. Motion declared carried

tion of City Code and Judiciary Committee, to authorize
City Attorney Hug and Corporation Counsel DiLeonardi to
locate an expert in real estate and municipal property
law for the settlement of having to do with rights of the
property owners with respect to certain easements in the
Prairie Avenue Parking Lot for subsequent concurrence by
the City Council, following the findings of the Committee that
Mayor Volberding was not in conflict of interest and did
not use his office in matters having to do with easements
on land owned by Mayor Volberding. Motion declared carried.

EMERGENCY Alderman Abrams, Chairman of City Code and Judiciary Committee
GENERATOR reported that the Committee reviewed the bid procedures
INSTALLATION pertaining to the award of contract to G & I Electric for
the installation of Emergency Generator and requested that
the contractor proceed with the work as the Committee found
that the bid procedures were appropriate.
LIQUOR Moved by Kisslinger, seconded by Koplos, to adopt the recom-
LICENSE mendation of License and Inspection Committee to deny
2580 Dempster request of Harpo's Restaurant for a Class A Liquor license
at 2580 Dempster Street. Motion declared carried.
GARAGE SALES Moved by Kisslinger, seconded by Leer, that the City issue
a permit at a cost of $2 to those persons holding garage
sales, that garage sales be limited to one per year for a
three day period ending 9 p.m. Sunday evening, one sign
be permitted in the front yard; no directional signs be
permitted on utility poli or parkways; sales be limited to
used items owned by person or persons having the sale;
no new merchandise be sold, as it is in violation of Zoning
Ordinance, and permit holders be advised of regulations
at time of issuance of permit, and in event a person holding
a sale moves, a second sale be allowed at the same address.
Following discussion, the roll call vote was:

mendation of License and Inspection Committee to concur with
Ordinance T-12-77, increasing vehicle license fees, amending
the fee for passenger motor vehicles, motorcycles and motor
driven cycles to $13 per year if purchased prior to January
1, 1977, to $14.00 if purchased from January 1 to March 1
and if purchased on or after March 1 at $19.00. Moved by
Leer, seconded by Ensign, to amend Ordinance T-12-77 to
reduce the license fee for motorcycles to 1/2 the above
stated figures. Upon roll call on the amendment, the vote

Mayor Volberding's appointment of Mr. Mark Henkes, 1047
Forest Avenue to the Youth Commission, term to expire
April 30, 1980 to fill vacancy created by resignation of
Mr. James Whittle. Motion declared carried.
Moved by Erbach, seconded by Sarlo, that the Mayor send
a letter of commendation to Mr. Whittle for his service
to the Youth Commission. Motion declared carried.
Alderman Seitz's request that the City again review its
policy regarding residency requirements for city employees
was referred to the City Code and Judiciary Committee.
Moved by Szabo, seconded by Sarlo, that the regular meeting
of the City Council adjourn. Motion declared carried.
