Motion declared carried. MINUTES OF THE ADJOURNED MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES HELD IN THE COUNCIL CHAMBERS CIVIC CENTER, MONDAY, April 25, 1977. CALL TO ORDER: The adjourned meeting of the City Council was called to order by City Clerk Rohrbach at 8:10 P.M., in the Council Chambers, Des Plaines Civic Center. ROLL CALL: Roll Call indicated the following aldermen present: Koplos, Szabo, Sullivan, Olen, Leer, Birchfield, Erbach, Sarlo, Meyer, Seitz, Abrams, Ward. Absent was Acting Mayor Bolek, Aldermen Brannigan, Kisslinger, and Kraves. Aldermen Brannigan and Kisslinger arrived immediately following roll call. CHAIRMAN Moved by Szabo , seconded by Leer, to nominate Alderman PRO TEM Abrams to serve as Chairman Pro Tem for this meeting. Moved by Koplos, seconded by Seitz to close nominations and declare Alderman Abrams elected Chairman Pro Tem. Motion declared carried. SEWER REPAIRS Moved by Koplos, seconded by Olen, to adopt the recommenda- PAYMENT tion of Water and Sewer Committee that the City pay the amount of $700 to Mr. Clarence E. Handley of 2056 Webster Lane as a partial payment for sewer repairs incurred by same to his residence, Mr. Handley to sign hold harmless agreement with City prior to receipt of this payment. Upon roll call, the vote was: AYES: - 14 - Koplos, Szabo, Sullivan, Olen, Leer, Brannigan, Kisslinger, Birchfield, Erbach, Sarlo, Meyer, Seitz, Abrams, Ward NAYS: 0 - None ABSENT: 2 - Kraves, Bolek Motion declared carried. CHILD Moved by Sullivan, seconded by Birchfield, to adopt the IDENTIFICATION recommendation of Health and Welfare Committee to support PROGRAM the Child Identification Program as proposed by Cumberland School PTA to instituted at Cumberland School as a pilot program - city's contribution involving an index at the Police Communications Desk. Motion declared carried. SIGN Moved by Olen, seconded by Koplos, to adopt the recommenda- Rand & River tion of Building Control and Inspection Committee to deny request of Standard Oil Service Station located at Rand Road and River Road to erect two additional signs 5 x 5 feet. Motion declared carried. FENCE Moved by Olen, seconded by Meyer, to adopt the recommendation 209 Washington of Building Control and Inspection Committee to grant fence permit to Clem J. Cerney, 209 Washington Street, to erect a 4' high solid fence in lieu of a 70o solid fence as required by ordinance. Motion declared carried. RESOLUTION Moved by Seitz, seconded by Szabo, to remove from the table R-9-77 the motion to adopt Resolution R-9-77, RESOLUTION OF THE Parking Lot CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, Lease AUTHORIZING SIGNATURE OF LEASE WITH DES PLAINES MALL Des Plaines CORPORATION CONCERNING RENTAL OF PRAIRIE-PEARSON PARKING Mall Corp. LOT. Motion declared carried. Moved by Leer, seconded by Seitz, to amend the Parking Lease as follows: Item 2, page 2, delete "In the event said bond issue is paid in full by Landlord before twenty (20) years from the commencement date, Landlord shall so notify Tenant and Tenant may terminate this Lease at any time thereafter during the twenty (20) years upon sixty (60) days written notice." /0' RESOLUTION R-9-77 Continued PRAIRIE- PEARSON PARKING LOT 4/25/77 155 Page Two Item 3 (f), page three, add "The rental shall be the amount which is negotiated by the parties. If the parties agree on a rental, a fair reasonable rental shall be determined by a qualified MAI appraiser mutually chosen by the Tenant and Landlord." Insert new Item 4 on page three as follows: "4. It is the intent of the parties that the Tenant shall provide reasonable free parking for shoppers. However, this would not prevent the use of some type of validation system." Renumber Item 4 to Item 5, and so on throughout the lease agreement. New Item 11, page 5, "however, the Tenant insert after "Landlord" in line two, shall not sublease any space at a rental that the Landlord is receiving pursuant to Paragraph 3 hereof." Motion to amend declared carried. Upon roll call on motion to adopt Resolution R-9-77, as amended, the vote was: Szabo, Sullivan, Olen, Leer, Brannigan, Kisslinger, Birchfield, Erbach, Sarlo, Meyer, Seitz, Abrams, Ward None Kraves, Bolek Koplos, as he National Bank declared carried. AYES: - 13 - NAYS: 0 - ABSENT: 2 - ABSTAIN: 1 - Motion is a stockholder of Des Plaines in the First Deferred motion brought to the floor. to award contract for Pearson -Prairie Parking Lot to Endurance Paving Co., in the amount of $92,360.55. Upon roll call, the vote was: AYES: - 14 - Koplos, Szabo, Sullivan, Olen, Leer, Brannigan, Kisslinger, Birhcfield, Erbach, Sarlo, Meyer, Seitz, Abrams, Ward NAYS: 0 - None ABSENT: 2 - Kraves, Bolek Motion declared carried. TRANSITIONAL Chairman Pro Tem Abrams questioned City Clerk and City CONSULTANTS Attorney re letter received by City Department Heads requesting certain information be provided to Mr. Alfred G. Ronan, Organizational Consultant, at the request of Mayor Elect Volberding. The matter of hiring the firm of Pandolfy-Weiss & Co. as transitional consultants was referred to City Code and Judiciary and Finance and Insurance Committees. Moved by Kisslinger, seconded by Koplos, to instruct City Clerk to notify immediately Mayor Elect Volberding and Pandolfy-Weiss & Co., of the above action having been taken by the City Council. Motion declared carried. City Council recessed from 9:06 P.M. to 12: 10 P.M. to canvass the votes cast at the election held April 19, 1977. Motion declared carried. Moved by Leer, seconded by Seitz, to nominate Alderman Koplos as Mayor Pro Tem until May 2, 1977. Moved by Meyer, seconded by Seitz, to close nominations and declare Alderman Koplos elected Mayor Pro Tem for the duration of Acting Mayor Bolek's term. Motion declared carried.
