01/17/1977MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES HELD IN THE COUNCIL CHAMBERS, CIVIC CENTER, MONDAY, January 17, 1977 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order by Acting Mayor Charles Bolek at 8:03 P.M. in the Council Chambers, Des Plaines Civic Center. ROLL CALL: Roll Call indicated the following aldermen present: Koplos, Szabo, Sullivan, Olen, Leer, Brannigan, Kisslinger, Birchfield, Erbach, Kraves, Sarlo, Meyer, Seitz, Abrams, Ward. Also present were: City Comptroller Blietz, Fire Chief Corey, Acting Building Commissioner Trost, Director of Zoning and Planning Richardson, Commissioner of Public Works Schwab, City Engineer Bowen, Environmental Officer Lindahl, Assistant Comptroller Placko, and City Attorney Hug. PRAYER & .The meeting opened with the Lord's Prayer, followed by PLEDGE the Pledge of Allegiance to the flag. MINUTES: BILLS PAYABLE FINANCE DEPT. EQUIPMENT SURVEY TRAFFIC SIGNALS Ellinwood, Miner, River NORTHWEST MUNICIPAL CONFERENCE Moved by Kisslinger, seconded by Sarlo, to approve the Minutes of the regular meeting held January 3, 1977, as published. Correction: Page Two, Paragraph four, item 2. change word "stats" to "slats"; Page five, paragraph eight, Howard Steven Liquor, Inc., line three, change "Class A" to "Class B". Following correction, motion declared carried. Moved by Kisslinger, seconded by Sarlo, to adopt the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME: Total, $362,122.71. Moved by Kisslinger, seconded by Ward, to adopt the recommendation of Finance and Insurance Committee to purchase for the Finance Department a new binding machine from NSC International, Inc., in the amount of $995.00. Upon roll call, the vote was: AYES: - 15 - Koplos, Szabo, Sullivan, Olen, Leer, Brannigan, Kisslinger, Birchfield, Erbach, Kraves, Sarlo, Meyer, Seitz, Ward_,.. Bolek. Moved by Brannigan, seconded by Erbach, to authorize City Engineer to contact Illinois Department of Trans- portation suggesting they conduct a survey of the intersection of Ellinwood, Miner, and River Road, and /� they be unable to conduct said survey, City Engineer ret f to solicit proposals from traffic engineering firms cin=sit to conduct this survey following approval by the City Council. Mr. William Muhlenfeld, Executive Director of the Northwest Municipal Conference submitted the annual report of the conference and its activities for the past year. 1/17/77 Page Two 113 NO PARKING Moved by Ward, seconded by Szabo, to adopt the recommenda- Janice & tion of Streets and Traffic Committee to install "No Elizabeth Parking" signs on the north side of Elizabeth and "No Parking Here To Corner" signs placed 25 feet from the corner on the west side of Janice and the south side of Elizabeth. Moved by Ward, seconded by Szabo, to adopt the recommenda- MFT tion of Streets and Traffic Committee to reduce the retention for the Lee Street Improvement (Howard to Mannheim) MFT #74 -00102 -01 -CG from 10% to 5.23%, making payment of $9,404.24 to Milburn Brothers. Motion declared carried. LIQUOR LIC. Moved by Kisslinger, seconded by Koplos, to adopt the Esser, Esser recommendation of License and Inspection Committee to & Schuld grant application to new owners of Isle of Man, Rand Rand & River and River Roads, James E. Esser, William P. Esser and Richard P. Schuld for a Class A and Class J liquor licenses. Motion declared carried. LIQUOR LIC. Moved by Kisslinger, seconded by Koplos, to adopt the Ground Round recommendation of License and Inspection Committee to Restaurant deny application for Class A liquor license of Howard Johnson Company, Ground Round Restaurant, 444 Des Plaines Avenue. Motion declared carried. Zoning Case Moved by Szabo, seconded by Erbach, to adopt the recom- 76-68-R mendation of Municipal Development Committee to grant 1745,55 Rand C-1 Commercial Zoning, Case 76-68-R, 1745,55 Rand Road conditioned to a covenant prohibiting use as psychiatric hospital or psychiatric treatment center (later changed to only psychiatric treatment center), City Attorney to draft necessary ordinance for further consideration. Motion declared carried. ZONING CASE 76-74-V 1783 Linden Moved by Szabo, seconded by Erbach, to adopt the recom- mendation of Municipal Development Committee to concur with Zoning Board of Appeals in Case 76-74-V, to grant variation at 1783 Linden St., City Attorney to draft necessary ordinance. Motion declared carried. ZONING CASE Moved by Szabo, seconded by Leer, to adopt the recommenda- 76-72-PUD tion of two members of Municipal Development Committee to 1471-81 concur with Zoning Board of Appeals in Case 76 -72 -PUD, Ellinwood 1471-81 Ellinwood St., City Attorney to draft necessary ordinance. Alderman Erbach made a minority report stating he is not in agreement with the proposed develop- ment. Motion declared carried. Aldermen Meyer, Sarlo, Erbach voted No. Alderman Koplos abstained due to a possible conflict of interest as a stockholder of First National Bank of Des Plaines. ORDINANCE Moved by Kraves, seconded by Meyer, to adopt Ordinance M-1-77 M-1-77, AN ORDINANCE MARKING APPROPRIATIONS TO DEFRAY APPROPRIATION THE EXPENSES OF THE CITY OF DES PLAINES FOR MUNICIPAL PURPOSES DESIGNATED THE "ANNUAL APPROPRIATION BILL" FOR THE FISCAL YEAR ENDING DECEMBER 31, 1977. Moved by Seitz, seconded by Erbach, to add a line item under Building Control and Inspection for Chief Building Inspector in the amount of $100.00. Aldermen Abrams, Meyer, and Sullivan, questioned Mayor Bolek re the proposed newsletter for the City of Des Plaines and requested that it be general in nature and not include comments from the alderman, and further questioned its publication prior to the election having been held City Engineer was requested to contact Illinois Department of Transportation re installation of barricade on the east side of Wolf Road at the intersection of Golf, Wolf and Seegers and follow up on request for reduction of speed on Golf Road. Alderman Birchfield's request for delay of trafficsignal at Wolf Rd. and Oakton Street to allow vehicles to turn west onto Oakton from Wolf Road was referred to City Engineer. 1/17/77 115 Page Four REFUSE Commissioner of Public Works was requested to contact BAGS stores requesting they carry refuse bags greater than 2 Mil strength. FIRE Fire Chief Corey commended the Mutual Aid Program in Maryville fighting the fire at Maryville Academy, which cost the City $380.00 for one million gallons of water; $2,200 overtime compensation, plus costs of gasoline and diesel fuel and $200 for damaged equipment. Also showed slides of the fire. LIQUOR LIC. Application for Liquor License, Class E, of Wah Foong Far East Moy and Feuy Goon Moy, doing business as Far East Restaurant Restaurant, 20 East Northwest Highway, was referred to License and Inspection Committee. ORDINANCE Moved by Meyer, seconded by Sarlo, to waive First Reading Z-5-77 and adopt Ordinance Z-5-77, AN ORDINANCE AMENDING SECTION Day Care 3A.2.6., 3A.2.16., 3E.2.6 and 3.E.2.9 OF THE DES PLAINES Centers ZONING ORDINANCE BY DELETING DAY CARE CENTERS IN CHURCHES AND TEMPLES AS PERMITTED USES IN RESIDENTIAL DISTRICTS AND ALLOWING THEM ONLY AS SPECIAL USES. Motion declared carried. Aldermen Sullivan and Abrams voted No. Moved by Meyer, seconded by Sarlo, to adopt Ordinance Z-5-77. ROYAL COURT Plat of Royal Court Subdivision approved by Plan Commission SUBDIVISION located at 925 Oakton Street was referred to Municipal Development Committee. IDOT Letter from Illinois Department of Transportation Yearly enclosing permit and yearly resolution for construction Resolution of State Highways was referred to Streets and Traffic Committee. DISANNEXATION Letter from Village of Rosemont re offer to purchase to Village of approximately five acres for favorable decision on Rosemont disconnection was referred to Municipal Development Committee. RESOLUTION Moved by Koplos, seconded by Erbach, to adopt Resolutions Park Ridge R-1-77 and R-2-77, R-1-77 to authorize the Public Works Sewer Department to restrict the opening from the Park Ridge Disconnect system at Lyman and Ballard to receive dry weather flows R-1-77 and give City of Park Ridge notice that the City of Park Ridge has until December 31, 1977 to make alternative arrangements for disposing of sanitary sewage from Mayfield Estates Subdivision; Resolution R-2-77, to be sent to Metropolitan Sanitary District complaining about the infiltration of the Mayfield Estate Subdivision's sanitary sewer by its storm water which is presently passed on to our sanitary sewer. Motion declared carried. ENV. COMMISSION Letter from Mrs. Inara Brubaker requesting a one year Leave of leave of absence from the Des Plaines Environmental absence Control Commission was referred to City Code and Judiciary Committee. EXAMINATION Placed on file was the State of Illinois Department of Firemen's Insurance recent examination of the Firemen's Pension Pension Fund Fund for Des Plaines. ,0/ LIME 1/17/77 Page Five 116 Moved by Kisslinger, seconded by Koplos, to authorize the opening of bid from Marblehead Lime Co. for Lime. MAYOR'S REPORT Mayor Bolek reported that a letter was received from Mrs. Beerworth commending Public Works Department for assistance with watermain break. He also reported he held a meeting with Mayor Bilandic of Chicago requesting discount on water rates charged to suburban communities - Mayor Bilandic to hold a meeting with Mayors; also, he spoke with him regarding the double standard used by cabs serving O'Hare Airport and expects information shortly.
