OF THE CITY COUNCIL OF THE CITY OF
DES PLAINES, ILLINOIS, HELD IN
THE COUNCIL CHAMBERS, CIVIC CENTER
MONDAY, June 21, 1976
CALL TO ORDER: The regular meeting of the City Council of the City of Des
Plaines was called to order by Mayor Herbert H. Behrel at
8 P.M. in the City Council Chambers, Des Plaines Civic
Center.
Roll Call indicated the following aldermen present:
Koplos, Olen, Bolek, Leer, Kisslinger, Birchfield, Erbach,
Kraves, Sarlo, Meyer, Seitz, Abrams, Ward.
Alderman Sullivan arrived following Prayer and Pledge of
Allegiance; Alderman Brannigan arrived following approval
of Minutes; Alderman Szabo arrived following approval of
Bills Payable.
Also present were: City Comptroller Blietz, Police Chief Hintz, Fire Chief
Corey, Acting Building Commissioner Trost, Assistant City Engineer Perl,
Director of Zoning and Planning Richardson, Commissioner of Public Works
Schwab, Environmental Officer Lindahl, Sanitarian M. Martin, Deputy Clerk
Trost, and City Attorney Hug.
PRAYER & The meeting opened with prayer by Rev. Jackson, pastor of
PLEDGE Christ Church, followed by the Pledge of Allegiance to the
flag.
BICENTENNIAL Mr. David Wolf, Chairman of the Bicentennial Commission
ART AWARDS presented the following with Awards in connection with
the Bicentennial Art Contest:

Sylvia Westgard; Second Place "Des Plaines _ Its Heritage and
Horizons" by Chris Erbach

Moved by Erbach, seconded by Kraves, to approve the Minutes
of the regular meeting held June 7, 1976, as published.
Corrections: Page Four, paragraph one strike "Touhy" Avenue
and insert "Howard Avenue "; Page Five, paragraphs 3,4,5,
add name of Mayor Behrel to those persons voting Aye.
Following correction, motion to approve declared carried.

Moved by Szabo, seconded by Meyer, to adopt the recommendation
of Municipal Development Committee to authorize Messrs.
Schwab, Bowen, Corey, Hintz, Richardson and Hug to study
the feasibility of the Annexation of Bay Colony area.
Motion declared carried.
Moved by Sullivan, seconded by Olen, to suspend the rules
to allow item of new business, the election of Acting Mayor
to be taken up following Committee Reports at this meeting.
Motion declared carried.
Alderman Koplos and Meyer withdrew motion to adopt the
recommendation of Water and Sewer Committee pertaining to
the lift station at Lyman and Ballard Road deferred at
meeting of June 7, 1976.
Moved by Koplos, seconded by Meyer, to adopt the revised
recommendation of Water and Sewer Committee to authorize
Mayor Behrel to write a letter to Park Ridge advising them
the City will terminate the sewer service to Mayfield
Estates Subdivision effective July 15, 1976. Motion declared
carried.
Aldermen Kisslinger and Birchfield voted no.
Moved by Koplos, seconded by Kisslinger, to adopt the recom-
mendation of Water and Sewer Committee to award the contract
for the construction of the Columbia and Seegers and Ballard
and Lyman Avenue Lift Stations to the low bidder, LoVerde
Construction Co., in the amount of $175,000 and return checks
or bonds of unsuccessful bidder. Upon roll call, the vote was:
AYES: 17 - Koplos, Szabo, Sullivan, Olen, Bolek, Leer,
Brannigan, Kisslinger, Birchfield, Erbach, Kraves,

Moved by Olen, seconded by Erbach, to adopt the recommendation
of Building Control and Inspection Committee to deny request
of MacDonald's to install a sign 200 square feet per side
and recommend the owner re- design the sigh to substantially
reduce the square footage. Moved by Leer, seconded by Bolek
to defer action.
SIGN Moved by Olen, seconded by Erbach, to adopt the recommendation
901 W. Oakton of Building Control and Inspection Committee to grant sign
variation request of Midwest American Dental, Inc. for two
ground signs approximately sixty square feet over existing
code, at 901 W. Oakton Street. Motion declared carried.
Alderman Bolek abstained from voting due to possible conflict
of interest.

1045 E. Oakton of Building Control and Inspection Committee to approve
variation for oversize sign at 1045 E. Oakton Street for
Acme -Wiley Sign Corporation to serve Dominicks - Walgreen
shopping center. Motion declared carried.
SIGN Moved by Olen, seconded by Birchfield, to adopt the recommend -
1111 E. Touhy ation of Building Control and Inspection Committee to
1001 E. Touhy grant request to replace four existing oversized signs at
1111 E. Touhy and 1001 E. Touhy Avenue. Motion declared
carried.
Moved by Olen, seconded by Leer, to adopt the recommendation
of Building Control and Inspection Committee to authorize
Building Department to send copy of all demolition permits
to Historical Society. Motion declared carried.
Moved by Olen, seconded by Meyer, to adopt the recommendation
of Building Control and Inspection Committee that sidewalks
be installed in all new developments, except those areas
that. City Council by variation would deem unnecessary...
City Attorney to draft necessary ordinance for further
consideration by City Council. Motion declared carried.
Moved by Olen, seconded by Erbach, to adopt the recommendation
of Building Control and Inspection Committee to deny request
of McKay - Nealis to install a sixty square foot per side
sign encroaching on 5 foot setback regulation off Oakton
Street. Motion declared carried.
Alderman Sullivan's request for review of procedure in the
issuance of building permits was referred to Building Control
and Inspection Committee.
Moved by Leer, seconded by Erbach, to adopt the recommendation
of Buildings, Grounds and Parking Lots Committee to approve
Change Order #2 adding $375.00 for changing one door to
"B" label door and deducting $4,290.00 for change in
surfacing, resulting in a net deduction of $3,915.00.

the obtaining of two proposals for the extension of the

Moved by Leer, seconded by Szabo, to adopt the recommendation
of Buildings, Grounds and Parking Lots Committee to rescind
action taken by City Council March 1, 1976, to authorize
Pinner Electric Co. to proceed with installing additional
stations to the Police Building Sound System, per proposal,
in the amount of $1,029.00 and to authorize Interstate
Electronics to install four additional stations to the
Sound System in the Police Building at a cost of $1,025.00,
said equipment compatable with present equipment. Moved
by Koplos, seconded by Erbach, to defer action and authorize
that Pinner Electric Company be contacted regarding the
above proposed action.
Moved by Seitz, seconded by Sarlo, to adopt the recommendation
of Fire and Civil Defense Committee to repeal Title 2,
Chapter 2, Section 1 -12 of the City Code, and adopt by
reference the new "Illinois Emergency Services and Disaster
Agency Act of 1975 by reference, City Attorney to draft
necessary ordinance. Motion declared carried.
MOVEd by Ward, seconded by Seitz, to adopt the recommendation
of Streets and Traffic Committee to authorize Change Order
#1 in the amount of $225.00 for Type C Service to be placed
on an existing power pole, in connection with installation
of Traffic Signals at Golf Road and Sixth Avenue, MFT
Section #75- 00110- 00 -TL. Upon roll call, the vote was:

to 9:30 A.M. and 3 P.M. to 4 P.M., School Days on Maple
Street, east side in front of Orchard Place School. Motion
declared carried.
Moved by Abrams, seconded by Koplos, to adopt the recommenda-
tion of City Code and Judiciary Committee to amend City Code
to provide an application for vacation, including $100
application fee plus $500 deposit for appraisal with any
excess being returned or additional being charged to
applicant, City Attorney authorized to prepare necessary
ordinance. Motion declared carried.
Moved by Abrams, seconded by Bolek, to adopt the recommenda-
tion of City Code and Judiciary Committee that the City
appeal to the Court of Appeals from the decision of Judge
Leighton dismissing complaint of City against MSD and EPA
and that Corporation Counsel DiLeonardi be retained to
perfect such appeal. Upon roll call, the vote was:

reported that Des Plaines Vanguards are seeking housing for
their equipment in the City of Des Plaines, and further that
he would appreciate any assistance in this area possible.
RESOLUTION Moved by Sullivan, seconded by Birchfield, to amend
R -3 -76 Resolution R -3 -76, having to do with selection of Acting
Acting Mayor, to require that voting be by voice vote. Upon roll

ELECTION Mayor Behrel appointed as tellers for the counting of ballots
ACTING for the office of Acting Mayor, Alderman Kisslinger,
MAYOR Alderman Brannigan, and City Clerk Rohrbach. Ballots were
distributed to all members of City Council. Upon canvass
the results were as follows:
Alderman Charles Bolek received ten votes
Alderman John E. Seitz received three votes
Alderman George Olen received three votes.
Alderman Charles Bolek was declared elected to the office
of Acting Mayor, effective August 7, 1976.
City Council recessed for five minutes at this time
Alderman Seitz was absent when meeting was reconvened.

HEAD TAX opposing the proposed Cook County Head Tax, and forwarding

LICENSE to do business at 688 Lee Street and the application of
APPLICATIONS the Plush Pup II Inc. for a Class F liquor license was
referred to License and Inspection Committee.
Hiring of Moved by Szabo, seconded by Ward, to adopt the recommendation
Mr. of Municipal Development Committee to hire Mr. David Outhred
David on a part time basis to assist the Department of Planning
Outhred and Zoning, at a cost not to exceed $2,500, in the develop-
ment of plans for the development of the north side of
Miner Street in connection with Redevelopment. Upon roll
