OCTOBER 7, 1996
CALL TO ORDER: The regular meeting of the City Council of the City of Des
Plaines, Illinois, was called to order by Mayor Ted
Sherwood at 7:00 P.M. in the Eleanor Rohrbach Memorial
Council Chambers, Des Plaines Civic Center on Monday,
October 7, 1996.
ROLL CALL: Roll call indicated the following aldermen present:
Beauvais, Christiansen, Elstner, Higgason, Curley, Sarlo,
Chiropolos, Arredia.
Also present were: Acting City Manager and Director of Finance &
Administration Peters, Assistant to the City Manager Carter, Director of
Economic Development Klaus, Police Chief Sturlini, Fire Chief Farinella,
Public Works Director Shirley, Community Development Director D'Onofrio,
City Engineer Oakley, Human Resources and Services Director Merriman and
Assistant City Attorney Gruber.
PRAYER AND The opening prayer was given by City Clerk McAllister,
PLEDGE: followed by the Pledge of Allegiance to the Flag.
CONSENT Alderman Beauvais requested that Item 2 be removed from
AGENDA: the Consent Agenda and Alderman Curley requested that
Items 6 and 6a be removed.
Moved by Arredia, seconded by Elstner, to establish a
Consent Agenda except for Items 2, 6 and 6a. Motion
declared carried.
Moved by Higgason, seconded by Elstner, to approve the
Consent Agenda. Upon roll call, the vote was:

Reading; and Resolution R -61 -96 is adopted.
MINUTES: Moved by Higgason, seconded by Elstner, to approve
Consent minutes of regular meeting of the City Council held
Agenda September 16, 1996, as published. Motion declared

EXECUTIVE Moved by Beauvais, seconded by Christiansen, to approve
SESSION minutes of Executive Session of the City Council held

POSITION Moved by Higgason, seconded by Elstner, to concur with
EVALUATION/ recommendation of Committee of the Whole held September
POLICE 16, 1996, to DENY request that salary range for the
RECORDS position of Police Records Supervisor be changed from
SUPERVISOR: $33,669 - $45,551 to $36,772 - $49,750, as called for by
Consent proposed Ordinance M- 61 -96. Motion declared carried as

REFUNDING Moved by Higgason, seconded by Elstner, to concur with

CITY: regarding American National Bank (DiMaso) v. Des Plaines;
Consent and Klein, Thorpe & Jenkins, Ltd., 180 N. LaSalle Street,
Agenda Suite 1600, Chicago, IL 60601, be retained to handle this
appeal. Motion declared carried as approved unanimously

SALE OP CITY Moved by Curley, seconded by Christiansen, to amend Staff
PROPERTY BY recommendation and proposed Ordinance M -65 -96 to remove
AUCTION: one of the cars from the list of vehicles to be sold by
auction through the Northwest Municipal Conference on
Ordinance Saturday, October 26, 1996, and said unmanned car to be
M - 65 - 96 placed at various intersections throughout the City to
help deter motorists from running stop signs. Upon roll
call, the vote was:

vehicles, four (4) Police Department vehicles (instead
of the five (5) recommended vehicles) and one (1) vehicle
seized by Police Department; and further recommend to
place on First Reading Ordinance M -65 -96 - AS AMENDED,
AN ORDINANCE AUTHORIZING THE SALE BY PUBLIC AUCTION OF
PERSONAL PROPERTY OWNED BY THE CITY OF DES PLAINES. Upon
roll call, the vote was:

Director of Public Works Shirley brought to the City
Council's attention that the only two vehicles that could
be used for traffic control purposes at stop sign
intersections are valued at $6,000 and $8,000.
Moved by Arredia, seconded by Beauvais, to reconsider
motion to authorize to sell by auction through the
Northwest Municipal Conference on Saturday, October 26,
1996, fifteen (15) Public Works vehicles, three (3) Fire
Department vehicles, four (4) Police Department vehicles
(instead of the five (5) recommended vehicles) and one
(1) vehicle seized by Police Department; and further
recommend to place on First Reading Ordinance M -65 -96 -
AS AMENDED, AN ORDINANCE AUTHORIZING THE SALE BY PUBLIC

Staff recommendation to authorize change of date of
temporary closing of southbound lane of River Road from

1996 to Sunday, November 3, 1996, from 10:00 a.m. - 11:30
a.m., to permit Maryville Academy to hold their Second

A2 and J Liquor Licenses for property located at 1450 E.
Touhy Avenue, d /b /a Des Plaines Holiday Inn, contingent
upon verification of fingerprints. Motion declared
carried.
TAXICAB Petitioner Lee W. Carpenter, President of Taxi Dispatch
LICENSES: Systems, Inc., addressed the City Council regarding his
request for an initial issuance of five (5) taxicab
licenses and an estimated increase of one (1) to two (2)
per month thereafter.
Moved by Arredia, seconded by Sarlo, to concur with Staff
recommendation and recommend to the City Council that
Taxi Dispatch Systems, Inc., 2064 S. River Road, Des
Plaines, IL 60018, be initially issued five (5) taxicab
licenses with an estimated increase of one (1) to two (2)
per month thereafter; and further recommend that
Ordinance M- 67 -96, authorizing the increase of taxicab
licenses from forty -nine (49) to seventy -four (74), be
placed on First Reading at appropriate time this evening.

WATER AND Moved by Chiropolos, seconded by Christiansen, that
SEWER discussion on the proposed Water and Sewer Improvement
IMPROVEMENT Projects be postponed until a Committee of the Whole
PROJECTS: meeting can be scheduled where this matter will be heard
and the meeting televised.

WARRANT Moved by Sarlo, seconded by Beauvais, to concur with
REGISTER: Staff recommendation and recommend to the City Council
approval of October 7, 1996 Warrant Register in the
amount of $2,925,979.18, and further recommend that
Resolution R -62 -96 be adopted at appropriate time this
evening. Motion declared carried.

City Council back in session.

PARKING PAD Moved by Arredia, seconded by Elstner, to amend motion
VARIATION/ which failed in Committee of the Whole held September 16,
456 ROSE: 1996, to grant request for a Variation to Section 111.7.1
of the Building Code to permit construction of a parking
pad 60' x 7.0' adjacent to existing driveway and 3' from
the side property line instead of the previously
requested 0.5', for a total driveway - parking pad area of
23.0' at its widest point, 60' long, and have a total
area of approximately 710 sq. ft., on property located
at 456 Rose Avenue. Motion declared carried.
1997 - 2001 Moved by Chiropolos, seconded by Sarlo, to concur with
CAPITAL recommendation of Committee of the Whole held September
IMPROVEMENT 30, 1996, to approve the 1997 -2001 Capital Improvement

LICENSES recommendation of Committee of the Whole that Taxi
Dispatch Systems, Inc., 2064 S. River Road, Des Plaines,
Ordinance IL 60018, be initially issued five (5) taxicab licenses
M -67 -96 with an estimated increase of one (1) or two (2) per
month thereafter; and place on First Reading Ordinance
M- 67 -96, AN ORDINANCE AMENDING SECTION 5 -5 -25.24 OF
CHAPTER 5 "OTHER BUSINESSES," OF TITLE V OF THE CITY CODE
OF DES PLAINES, TO INCREASE THE NUMBER OF VEHICLE
