CALL TO ORDER: The special meeting of the City council of the City of
Des Plaines, Illinois, was called to order by Mayor
John E. Seitz at 7:07 P.M. in the Eleanor Rohrbach
Memorial Council Chambers, Des Plaines Civic Center on
Monday, August 31, 1987.

Also present was City Attorney Smith.

PLEDGE:
Mayor Seitz announced that the meeting called at the request of Aldermen
Gebert, Hervas and Childers, is to reconsider resolutions R- 15 -87, R -16 -87
and R- 17 -87, and asked City Attorney Smith to comment on his response
(see attached) to Alderman Childers' letter of August 26, 1987 (see
attached).
City Attorney Smith stated that the memorandum was self - explanatory.
Moved by Schneck, seconded by Adams, that the special meeting of the City
Council adjourn. Upon roll call, the vote was:

RE: Response to Ms. Childers' Letter of August 26, 1987
In response to a letter dated August 26, 1987, from Alderman
Childers to Mayor Seitz, copy to City Attorney, please be advised
as follows:
Your statement, "I telephoned the Cook County Clerk's office
and... the Attorney informed me that a municipality can in fact
reconsider an action that it has created ", is in itself true, as
long as one of several things has not intervened or occurred:
(a) an affirmative vote whose provisions have
been partly carried out (such as the filing
of the referenda with the County Clerk,
a different governmental body);
(b) when practically the same result as desired
can be obtained by some other parliamentary
motion (an example, of this would be a motion
to rescind);
(c) ...when the rights of other persons have
intervened (City of Kankakee v. Small,
317 I11. 55), (in this case, those individuals
who supported the referenda and other rights
vested when these matters were filed with the
County Clerk);
(d) when the rights of a third party has intervened
...and the Council seeks to reconsider previous
action based upon an erroneous legal view
(International Society, etc. v. City of
Evanston, 53 Il1.App.3d 44), (in this case,
thosindividuals who supported the referenda and
other rights vested when these matters were
filed with the County Clerk); and

(e) to repeal under McQuillin at 21.10.
There is no implication of power to repeal,...
where an ordinance has been enacted under a
narrow, limited grant of authority to do a
single designated thing in a manner and at the
time prescribed by the legislature, which
excludes the implication that the legislative
body of the city is given any further
jurisdiction over the subject than to do the
one set. (People v. Illinois Municipal
Retirement Fund, 6 I11.2d 405 and
People v. Ellis, 253 I11. 369.)
It is with the above references that I question this matter may
be reconsidered. Further, as I originally stated at the Council
Meeting on August 17, 1987, once the City of Des Plaines acts and
then files referenda with another governmental body, it is
questionable whether we may act any further. Why? Because a
third party, County of Cook, has received and taken jurisdiction
of this matter. The County of Cook will not accept a
reconsideration on a Tax Levy or an appropriation ordinance but
it will on an election matter! That, then, is a discretionary
action on the part of the County Clerk, within the statutory
language.
In order for the movants to have retained jurisdiction of the
matter, it was necessary for them to have done one of the
following:
Moved to reconsider on the 6th of August, or
Moved to reconsider on the 17th of August, or
Moved to overrule the Chair.
Prior to the reconsideration on the 17th of August, the movants
(City Council Aldermen) should have been prepared. To do this,
the Aldermen should have asked the Mayor, County Clerk, or
myself, the question of whether the County would or could
consider a subsequent motion to remove any referenda. The
movants, Aldermen Gebert and Childers, did not do so; therefore,
the movants cannot now plead ignorance and say they were
misinformed or did not know when it was their burden to bring the
motion properly.
In the alternative, the movants could have brought the motion and
had it tabled or held for further input from the County - they
did not.

In the alternative, the movants should have challenged the Chair
on its ruling - they did not.
For these reasons, it is my position that the Chair ruled
correctly and the time for reconsideration has passed.
Finally, I had delivered to me, on August 31, 1987, by a member
of The State Board of Elections, The State of Illinois Election
and Campaign Finance Calendar - 1987, and at page 50 it states
(see Exhibit A attached): "Sunday, August 30, 1987, Last day for
local governing boards to adopt a resolution or ordinance... to
appear on the ballot." (Chapter 46, S28 -2) (Emphasis added)
(Although this references binding questions, there is no other
statute or date as to advisory referenda.)
Therefore, I point this out, since the County said you have until
September 3rd to certify (Chapter 46, §28-5). This is true -
however, the action must take place on or before August 30th
(Chapter 46, X28 -2). See Mierswa v. Kusper, 121 I11.App.3d 430.
In Mierswa v. Kusper, it says that if the action can be taken by
the date, i.e. the City Council could have met Friday, Saturday,
or Sunday, and the time for filing is subsequent, the action
fails. Thus, although the Clerk has till the 3rd of September to
certify, only actions enacted on or before the 30th of August are
applicable. So, your waiting till August 31st is too late and
your statement that you have until the 3rd of September to act to
remove, is in error.

After the August 17 City Council meeting, I am still concerned
about your decision based on the advice and recommendation of
City Attorney Smith to not allow Alderman Bruce Gebert to
propose reconsideration of the three referenda being placed on
the November 3, 1987 ballot.
I telephoned the Cook County Clerk's office and spoke to
Attorney Barbara Goodman, Assistant to the Director, County
Clerk. Attorney Goodman informed me that a municipality can
in Fact reconsider an action that it has created. September 3,
1987 is the deadline For certification of referenda on the
November 3,1987 ballot. We have until this date of September 3
to remove the referenda from the November ballot by a City
Council reconsideration of these items.
Both Mary Hanna 6 Bud Phillips of the Keep Des Plaines Beautiful
Commission and James Kosthorys of the Des Plaines Prairie Project
have contacted me to express their intense desire to not have
their organizations be represented in a referendum at this time.
They never requested to be on the November ballot and are now
requesting to be removed From this ballot.
Since this action can only be proposed by a member of the City
Council that voted on the prevailing side at the Special City
Council Meeting held August 6 and Alderman Gebert expressed his
Change of heart at our last City Council meeting, Aug. 17; I
request that you do indeed allow reconsideration of these
referenda at a Special City Council meeting as soon as possible
before September 3.
