MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES,
ILLINOIS, HELD IN THE ELEANOR ROHRBACH
MEMORIAL COUNCIL CHAMBERS, DES PLAINES
CIVIC CENTER, MONDAY, MAY 4, 1987
The regular meeting of the City Council of the City of
Des Plaines, Illinois, was called to order by Mayor
John E. Seitz at 8:10 P.M. in the Eleanor Rohrbach
Memorial Council Chambers, Des Plaines, Civic Center
on Monday, May 4, 1987
Roll Call indicated the following Aldermen present:
Muehlenbeck, Childers, Christiansen, Bonk, Healy,
Wetter, Schneck, Kisslinger, Adams, Hardiman, Gebert,
Sarlo, Chiropolos, Addante, Hervas, Haupt.
Also present were: City Treasurer Fredricks, City Comptroller Peters,
Commissioner of Public Works Matula, Fire Chief Clark, Police Chief
Kozenczak, City Engineer Shrake, Municipal Development Department Acting
Director McKoveck, Human Resources and Services Department Director
Donahue, Administrative Officer Wildenberg, and Corporate Attorney
Lucansky.
The opening prayer was given by Pastor Charles Cooper,
Golf Road Baptist Church, followed by the Pledge of
Allegiance to the Flag.
PRESENTATION: Mayor Seitz congratulated the Maine West High School
Girls Basketball team and their coach who finished
third in the State of Illinois, and presented
Certificates of Appreciation to them for bringing
honor to the City of Des Plaines.
Moved by Bonk, seconded by Sarlo, to approve Minutes of
the regular meeting of the City Council held April 20,
1987, as published. Motion declared carried.
Moved by Muehlenbeck, seconded by Schneck, to ratify
Purchase Order #47254 to Albrecht Enterprises, 2855
Orchard Place, Des Plaines, 60018, in the amount of
$59,210, for emergency services to remove five fuel oil
tanks and the contaminated soil from the property on
the south side of Ellinwood Street from Center Street
to Pearson Street. Upon roll call, the vote was:
AYES: 16- Muehlenbeck, Childers, Christiansen, Bonk,
Healy, Wetter, Schneck, Kisslinger, Adams,
Hardiman, Gebert, Sarlo, Chiropolos, Addante,
Hervas, Haupt
NAYS: 0 -None
ABSENT: 0 -None
Motion declared carried.
Moved by Muehlenbeck, seconded by Schneck, to adopt the
following resolution: BE IT RESOLVED BY THE CITY
COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING
BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY
CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR
SAME. Total: $699,729.53. Upon roll call, the vote
was:

Motion was made by Alderman Healy to amend the motion.
After much discussion as.:to:.whether this amendment to ::
this Motion could be made, Alderman Hervas called for a
ruling from the Chair.
Mayor Seitz ruled that the original motion will be
voted on and if it fails, the matter would be referred
back to committee for further review and report.
Moved by Hervas, seconded by Schneck, to appeal the
ruling of the Chair.
Moved by Chiropolos, seconded by Adams, to defer this
matter until the next regular Council meeting.
After conferrirg with the Corporate Attorney, Mayor
Seitz ruled that the deferral will stand.
Moved by Hervas, seconded by Schneck, to appeal this
ruling.
After more discussion, Alderman Hervas again called for
a vote on his appeal.
Mayor Seitz stated that Council's practice has been that
committee reports moved and seconded for deferral are
automatically moved to the next meeting.
Alderman Hervas stated he had an absolute right to an
appeal and wants that appeal voted on.
Mayor Seitz stated that the Corporate Attorney indicate:
that a motion for deferral stands because of past
practice.
Alderman Hervas again asked for a vote,as proper
parliamentary procedure.
Mayor Seitz stated that the Chair has accepted a motion
and second for deferral which is normal Council
practice. He said it is not his ruling, it is recog-
nition of Council practice.

Alderman Hervas stated he would not desist from his
appeal based on parliamentary rights.
Mayor Seitz stated that the deferral stands.
Again, Alderman Hervas stated that he would not desist
from his appeal and wants the appeal to be voted.
Mayor Seitz ruled Alderman Hervas out of order, and
that the motion made stands.
Under Unfinished Business, moved by Healy, seconded
by Hervas, to submit a committees structure for the
City of Des Plaines. Mayor Seitz ruled that the
procedure has been to introduce non - agenda items after
all agenda items have been taken up under New Business.
Mayor Seitz called for a special meeting of the City
Council for Wednesday, May 13, 1987 at 7:30 P.M. in
Room 102 re Verified Petition for Election Contest by
Judith H. Zanca contesting the election of Carl P.
Haupt to the office of Alderman for the four (4) year
term of the 8th Ward of the City of Des Plaines at
the Consolidated Election held April 7, 1987.
Alderman Sarlo, Chairman, called for a meeting of the
Committee on Committees for Monday, May 11, 1987 at
7:30 P.M. in Room 101.
Placed on First Reading was Ordinance M- 17 -87, AN
ORDINANCE INCREASING CLASS E LIQUOR LICENSES BY ONE (1)
THEREBY AMENDING SECTION 5 -34 -16 OF THE DES PLAINES
CITY CODE (COLBY'S SQUARE)
Held on First Reading was Ordinance T -4 -87, AN
ORDINANCE AMENDING SECTION 10 -3 -1 OF CHAPTER 3, TITLE
X, OF THE DES PLAINES CITY CODE, ADDING THERETO A NEW
SUBSECTION 10- 3 -1(N) PROHIBITING WEST BOUND TRAFFIC IN
THE RIGHT LANE OF PRAIRIE AVENUE TO MAKE A LEFT HAND
TURN ONTO LEE STREET.
Moved by Muehlenbeck, seconded by Childers, that City
enter into an agreement with Lifelink (formerly
Bensenville Home Society), 331 S. York Road, Bensen-
ville, IL 60106, for subsidized housing for the elderly
on the north part (28,750 sq. ft.) of the North School
commuter parking lot to be sold at market value at the
time of title and Resolution R -9 -87, supporting the
application of Lifelink to HUD for this project, be
adopted. Upon roll call, the vote was:

Healy, Wetter, Schneck, Kisslinger, Adams,
Hardiman, Gebert, Sarlo, Chiropolos, Addante,
Hervas, Haupt

Mayor Seitz's appointments /reappointments to the Des
Plaines Zoning Board of Appeals as follows:

Earle P. Stover, Jr., term to expire April 30, 1992
James Szabo, term to expire April 30, 1992
Motion declared carried. Alderman Schneck voted no.

Alderman Healy brought up his motion on submitting a
committees structure make under Unfinished Business.
Mayor Seitz ruled the motion out of order since the
matter has been returned to committee.
At the request of Alderman Kisslinger, Mayor Seitz
referred the matter of the procedure for nominating
the members of the Committee on Committees to the
License & Judicial Committee.
Moved by Bonk, seconded by Sarlo, that the regular
meeting of the City Council adjourn. Motion declared
carried. Meeting adjourned at 10:01 P.M.
