ZONING BOARD PRESENT: Szabo, Saletnik, Hofherr, Schell, Porada ABSENT Seegers, Catalano ALSO PRESENT Scott Mangum, Senior Planner, Department of Community & Economic Development Gale Cerabona, Recording Secretary Acting Chair Szabo called the meeting to order at 7:30 p.m. & read this evening's case. APPROVAL OF MINUTES: A motion was made by Board Member Hofherr, seconded by Board Member Schell, to approve the meeting minutes of November 25, 2014, as presented. Golf Road Case Number: 14-085-V Petitioner is requesting a variation to Section 11.6.B of the 1998 City of Des Plaines Zoning Ordinance, as amended to allow a wall sign of approximately 150 square feet, where a maximum of 100 Square feet in size is allowed by code. Golf Road December 9, 2014 Page 2 Acting Chair Szabo swore in Michael Pagan, Architect, Milord Company, 9801 Industrial Drive, Bridgeview, IL 60455 who is representing Petitioner, Donald Rickard (also with Milord Company). Mr. Pagan advised there is an existing sign that does not conform to the Binny's brand. He noted the code is 100 sq. ft., and the current sign is 175 sq. ft. A reduction is being sought for 150 sq. ft. to update the sign. Acting Chair Szabo asked if the sign is going in the same location. Mr. Pagan advised — yes. Board Member Porada asked/noted: • if this is the first time Petitioner has worked on a Binny's project. Mr. Pagan advised — no, Milord Company manages all of Binny's signs • if Petitioner is requesting 150 sq. ft. Mr. Pagan advised — yes • other City signs (Planet Fitness) have been recommended for denial by the ZBA • if Petitioner envisions the sign as proposed to remain the same in the future. Mr. Pagan advised — yes, client is aware this is the largest the sign size will be (and is in accordance with Zoning Code) • if the `Binny's" text will be the same size. Mr. Pagan advised — in the past, the "beverage depot" was larger; however, now that has changed and the `Binny's" text is larger • if the text "beverage depot" has been dropped elsewhere. Mr. Pagan advised — no • Staff if the size is measured from the top of the B (in Binny's) to the bottom of the beverage depot letters. Mr. Mangum referred to Exhibit A displaying the sign area computation. Board Member Saletnik asked if/stated: • staff at Milord Company drew the graphics. Mr. Pagan advised — no, the client develops the graphics • this is a much better sign aesthetically and proportionately Acting Chairman Szabo asked Staff to provide the summary report. Issue: The petitioner is requesting a variation to Section 11.6.B of the 1998 City of Des Plaines Zoning Ordinance, as amended: to allow a wall sign of approximately 150 square feet, where a maximum of 100 Square feet in size is allowed by code. Golf Road PIN: 08-13-102-017-0000 Existing Zoning: C-4, Regional Shopping Commercial District Petitioner: Donald Rickard (for Binny's Beverage Depot), 9801 Industrial Drive, Bridgeview, IL 60455 Owner(s): Chicago Exhibitors Corporation, 20 N. Martingale Road, Suite 100, Schaumburg, IL 60173 In reviewing this variation request, staff has considered the following information: Binny's Beverage Depot is requesting a variation to replace the existing approximately 170 square foot channel letter wall sign with a new approximately 150 square foot wall sign. Section 11.6B of the Zoning Ordinance allows three square feet of wall signage per one linear foot of building frontage up to 100 square feet. The applicant sites the distance from the roadway and obstruction of outlot buildings as reasons for the request. Case #14-085-V 767 W. Golf Road December 9, 2014 Page 3 Based on permit records, existing and previous tenants within the shopping center have/had signs of the following sizes: Dollar Tree (82.5 SF), Party Time Palace (100 SF), International Fresca Market (100 SF), Planet Fitness (148 SF), and Wal-Mart Neighborhood Market (144 SF). Major variations were approved for the Planet Fitness wall sign in 2011 and Wal-Mart walls signs in 2014. Multi -tenant pole signs are located at the perimeter of the property along both Golf and Elmhurst Roads. The request is a major variance, as the size requested is more than 10% greater than allowed by code for a wall sign. Recommendation: Staff recommends approval of the requested wall sign variation based on review of the information presented by the applicant and the standards and conditions imposed by Section 3.6-8 (Findings of Fact for Variations) as outlined by the City of Des Plaines Zoning Ordinance. The large setback from the street and recent approvals for wall sign variations within the same shopping center are contributing factors in the recommendation. Zoning Board of Appeals Procedure: Under Section 3.6-7 of the Zoning Ordinance (Major Variations) the Zoning Board of Appeals has the authority to recommend that the City Council approve, approve subject to conditions, or deny the variance for wall sign that is greater than 100 square feet. The City Council has the final authority on the project. Acting Chair Szabo asked if the Board has any questions or if anyone in the audience objects or is in favor. No one responded. A motion was made by Board Member Saletnik, seconded by Board Member Hofherr, to recommend approval to City Council to grant the variation as presented.
