MINUTES
The Des Plaines Zoning Board Meeting held its regularly scheduled meeting on Tuesday, April 8, 2014, at 7:30 p.m.
in Room 102, City Council Chambers, of the Des Plaines Civic Center.

Chairman Seegers called the meeting to order at 7:35 p.m. Roll call was conducted. Chairman Seegers read this
evening's case.
APPROVAL OF MINUTES:
A motion was made by Board Member Szabo, seconded by Board Member Hofherr, to approve the meeting
minutes of March 11, 2014, for Case 14-002-V & 14 -006 -CU as wiitten.

Petitioner is requesting a variation to Section 7.2-4D of the 1998 City of Des Plaines Zoning Ordinance, as
amended: to authorize the construction of a 360 square foot detached two -car garage with a building
coverage of approximately 31.5%, where a maximum of 30% is allowed within the R-1 zoning district.

Chairman Seegers swore in Representative/Petitioner Victor Gornikowski, 1818 Sycamore Street, Des
Plaines, IL.
Chairman Seegers asked:
• if Petitioner is building a 2 -car garage on the property. Petitioner advised — yes, an 18x20
minimum -size garage is being built on the property
• what the material is. Petitioner advised — frame with siding
• if it's a 2 -car garage. Petitioner advised — yes; is asking for a variance due to 30% requirements
Board Member Hofherr asked:
• are you going to remove the existing shed? Petitioner advised — yes
Board Member Szabo asked:
• what is the relationship to the owner? Petitioner advised — he is the husband of one of the owners,

• how are they related to owner? Petitioner advised — we are friends
• are you aware of the landscaping requirements? Petitioner advised — yes
• Staff, why is the removal not a condition? Mr. Mangum advised — the shed is included in the
31.5%; an 18x20 garage is quite small
Chairman Seegers asked Mr. Mangum to summarize the staff report.
Issue: Petitioner is requesting a variation to Section 7.2-4D of the 1998 City of Des Plaines Zoning

In reviewing this variation request, staff has considered the following information:
The 50 -foot by 125 -foot (6,250 square foot) lot at 1984 Illinois Street is a legal nonconforming lot with
regards to both lot width and lot size in the R-1 District. A one story frame single-family residence and 30
square -foot movable shed currently exists on site. The applicant proposes to construct a one-story, 360
square foot (18 -foot by 20 -foot) two -car detached garage which would be accessed from the alley. The
applicant states that the added size would allow for a two -car garage.
The existing house covers approximately 26% of the lot. The proposed garage would place the total
building coverage at approximately 1,972 square feet (31.5%), where the zoning ordinance allows a
maximum building coverage of 1,875 square feet (30%). The owner acquired the property in 2013 and
received a building permit to remodel the house without increasing the footprint. Per Section 3.6-6 of the
Zoning Ordinance, lot coverage of up to 20% over the maximum requirements may be allowed as a
standard variation.
Recommendation: Staff recommends approval of the above -requested lot coverage variation based on
review of the information presented by the applicant and the standards and conditions imposed by Section
3.6-8 (Findings of Fact for Variations) as outlined by the City of Des Plaines Zoning Ordinance, subject to
the following condition of approval:
1. The gravel area at the rear of the property between the proposed garage and the side property lines
shall be landscaped and shall not be used for the parking of vehicles or equipment.
Staff is recommending approval of the variation because the subject property is nonconforming in regards
to both lot width and size, and the proposed garage is the minimum size for a two -car garage.
Zoning Board of Appeals Procedure
Under Section 3.6-6 of the Zoning Ordinance (Standard Variations) the Zoning Board of Appeals has the
authority to approve, approve subject to conditions, or deny the above-mentioned variance for lot coverage
for an addition to a single-family residence in the R-1 zoning district.
Chairman Seegers asked the Board if there are any further questions.
Board Member Porada asked:
• Staff if the code states a shed is an accessory structure. Mr. Mangum advised — yes
• Staff, what else is considered an accessory structure? Mr. Mangum advised — a garage
Chairman Seegers asked if anyone in the audience is in favor of or objects. There was no one in the
audience.
Board Member Szabo stated this will improve the property.

A motion was made by Board Member Szabo, seconded by Board Member Hofherr, to grant the
variation at 1984 Illinois Street with the condition as noted in the Staff report and removal of the
shed.
Mr. Mangum advised the percentage without the shed would be approximately 31.1%.
Board Member Saletnik asked Petitioner where lawn mower & other items will go. A brief discussion took
place. Petitioner advised — the garage is the priority; he will remove the shed if necessary.
Board Member Szabo withdrew the motion.
Board Member Porada asked Petitioner what is in the shed now? Petitioner advised — nothing.
A motion was made by Board Member Porada, seconded by Board Member Hofherr, to grant the
variation with the condition as noted in the Staff report, removal of the shed, & no sheds present on
the property.

Mr. Mangum advised that there will not be a meeting on April 29, 2014; the next regularly scheduled meeting would
