Moylan at 6:00 p.m. in the Eleanor Rohrbach Memorial Council Chambers, Des Plaines Civic Center on Tuesday, September 6, 2011. ROLL CALL: Roll call indicated the following Aldermen present: Robinson, Bogusz, Sayad, Walsten, Wilson and Charewicz. Alderman Haugeberg arrived at 6:07 p.m. Alderman Brookman arrived at 6:10 p.m. Also present were: Acting City Manager Slowinski, Director of Finance Wisniewski, Police Chief Prandini, Fire Chief Wax, Director of Human Resources Earl, Director of Community & Economic Development Bartholomew, Director of Public Works and Engineering Oakley, Director of Information Technology Duebner and Attorney Ray Bartel. EXECUTIVE SESSION: PRAYER AND PLEDGE: CITIZEN PART.: Moved by Bogusz, seconded by Sayad, to go into Executive Session to discuss Collective Bargaining. Motion passed unanimously without objection. The City Council recessed at 6:01 p.m. The City Council reconvened at 7:00 p.m. Roll call indicated the following Aldermen present: Haugeberg, Robinson, Bogusz, Sayad, Brookman, Walsten, Wilson and Charewicz. The opening prayer was given by President Ghulam Farooqie of the Islamic Community Center, followed by the Pledge of Allegiance to the Flag. Mr. Wayne Serbin, 835 Pearson Street, addressed the City Council congratulating the young lady in the audience for winning numerous medals; he attended a workshop in Wheeling on August 1 sc at 6:00 p.m.; Wheeling uses a workshop method and not Committee of the Whole; they meet at 6:00 p.m.; there were no reporters present; he gave a copy of the agenda and monthly bulletin he collected to the City Clerk for future reference by Council members (in Council file). Mr. Andy Samborski, 2108 Sherwin, a member of the Knights of Columbus, addressed the City Council stating that this organization helps people; tag days will take place September 16-18; he invited people to volunteer at the Special Olympics Bowl-a-thon at the River Rand Bowl on October 23; he introduced a young lady named Megan who participated in Special Olympics and won numerous medals. Megan stepped forward and read a statement about her experiences as an athlete in Special Olympics Illinois. Mr. Samborski invited volunteers to call him at 847-296-1457. CITIZEN PART.: (Cont' d) CONSENT AGENDA: Page 2 of 13 9/6/11 Mr. Ron Moore, 1480 Jefferson Street, addressed the City Council regarding the reduction in city services such as no longer receiving minutes, notices and agendas by mail; can the agenda be posted on Channels 17 and 24?; he requested that the program schedule be posted more often. Mr. Moore suggested that acronyms listed on the agenda be spelled out so that residents can understand what they stand for; regarding Channel 24, is a traffic report for Chicago necessary? Mr. Brian Burkross, 2133 Webster Lane, addressed the City Council stating that he had problems with the new City website finding minutes and agendas from various meetings; this should be fixed immediately; he reviewed his notes and will make copies to give to the City Clerk; he stated that the old website and the new website had error messages; he suggested changes to improve access; he asked why the old website is half cannibalized and the new website was half complete; this has caused a lot of confusion; hopefully this will be cleared up in the next few days; he is Vice President of a motorcycle club called Iron Justice which holds an event called Ride for Kids; he apologized for not coming here last year to personally thank Police Chief Prandini and the City for their support; he will submit a request for the first Sunday in October and provide more details at the next Council meeting to encourage residents to see 500 bikes roll through our city. Mr. Colin Carroll, 1313 Oakton Street, addressed the City Council asking, on behalf of his mother, why when Des Plaines had a referendum for a strong city manager form of government and we don't have a city manager, doesn't this bypass the referendum or is there something in place that allows for that through the assistant city manager having the same responsibility and authority; is that position described in state statute? Attorney Bartel suggested that Mr. Carroll submit his question in writing to City Attorney Wiltse for a proper answer. Mr. Carroll stated that he did submit this question in writing to the City Attorney. Attorney Bartel stated that that is the person who would answer the question. MAYOR MOYLAN DECLARED THAT THE CITY COUNCIL WAS NOW RESOLVED INTO A COMMITTEE OF THE WHOLE FINANCE & ADMINISTRATION - Alderman Bogusz, Chair Alderman Bogusz stated that the first item under Finance & Administration is to approve the September 6, 2011 Warrant Register in the total amount of $3,760,466.63. Alderman Sayad referred to Page 1 of the Warrant Register and asked about the payment of $1,000.00 for membership dues to the Des Plaines Arts Council; what do we get for that $1,000.00? Director of Finance Wisniewski responded that this is under the Elected Office division and she did not have back up information. Alderman Sayad requested information on the benefits of this rate for membership. Alderman Sayad referred to Page 30 of the Warrant Register and asked about the reimbursement to the Des Plaines Theater for Facade Windows/Doors in the amount of $4,978.70, and reimbursement to the Greek American Restaurant Association for Exterior Renovations in the amount of $41,000.00. Director of Finance Wisniewski responded that these were approved at a prior Council meeting; they are precut checks. _ Page 5 of 13 9/6/11 WARRANT Alderman Sayad stated he would like an asterisk to be added to indicate a REGISTER: precut check; he will vote no for these two reimbursements. (Cont'd) Mr. Wayne Serbin, 835 Pearson Street, addressed the Committee of the Whole stating that Alderman Sayad is complaining about the membership fee; he pays $20; Mr. Sayad is right; the $1,000.00 membership fee has certain benefits. Mr. Ronald Moore, 1480 Jefferson Street, addressed the Committee of the Whole stating that after reviewing the Warrant Register at the Library, he referred to Page 2 of the Warrant Register and asked about the charge under Media Services for Hinckley Springs Water in the amount of $45.15 under Office Supplies; is this really necessary? Director of Finance Wisniewski pointed out that this particular expense was listed under the category of Human Resources, not Media Services; it is for renting the water cooler for employees. Mr. Ron Moore, 1480 Jefferson Street, addressed the Committee of the Whole asking if it is really necessary to have spring water; this is a blatant unnecessary expense. Mayor Moylan responded that you cannot drink the water in the fountains because of the age of the pipes located in certain parts of City Hall. Moved by Haugeberg, seconded by Walsten, to recommend to the City Council approval of the September 6, 2011 — Warrant Register, in the total amount of $3,760,466.63; and further recommend that Resolution R-117-11 be adopted at appropriate time this evening. Motion declared carried. Alderman Sayad voted no for the reimbursement to the Des Plaines Theater for Facade Windows/Doors in the amount of $4,978.70, and reimbursement to the Greek American Restaurant Association for Exterior Renovations in the amount of $41,000.00 (both items on Page 30 of the Warrant Register). FIRE DEPT. Fire Chief Wax stated that this is a continuation of a conversation to reduce CIVILIAN salary and pension related costs; the Fire Department is requesting a position TRAINING change from sworn to civilian of a Training/Safety Officer position in the Fire OFFICER Department structure within the City Code. POSITION: Fire Chief Wax answered questions from the Aldermen regarding the change in position. Director of Finance Wisniewski answered questions from the Aldermen regarding the position being filled, its affect on the budget and future savings. Moved by Walsten, seconded by Haugeberg, to recommend to the City Council to place on First Reading Ordinance M-38-11 at appropriate time this evening. Mr. Brian Burkross, 2133 Webster Lane, addressed the Committee of the Whole asked for a clarification for the change from sworn to civilian position. �a� Page 6 of 13 9/6/11 OFFICER Fire Chief Wax gave a detailed explanation on the effects of this change. POSITION: (Cont'd) Motion declared carried. Aldermen Robinson, Sayad and Wilson voted no. COMMUNITY DEVELOPMENT — Alderman Haugeberg, Chair COND. USE EXT./ Alderman Haugeberg stated that the first item is the Conditional Use Extension 254 LAUREL request for 254 Laurel Avenue. AVE.: Senior Planner Mangum reviewed his Memorandum of August 2, 2011 regarding a 12 -month extension of the Conditional Use for the preliminary Planned Unit Development for Phase II of the Lexington Park project; staff recommends that the project be granted an extension until August 6, 2012. Mr. Wayne Serbin, 835 Pearson Street, addressed the Committee of the Whole stating that economy is in bad shape; don't be surprised if he comes back for another extension next year. COND. USE/1249 ELMHURST RD.: Moved by Wilson, seconded by Walsten, to recommend to the City Council to place on First Reading Ordinance Z-25-11 at appropriate time this evening. Motion declared carried. Alderman Haugeberg stated that the second item is a Conditional Use Permit for a Place of Worship at 1249 Elmhurst Road, Case #11 -029 -CU. Senior Planner Mangum reviewed his Memorandum of August 9, 2011 regarding a Conditional Use Permit for a Place of Worship, 1249 Elmhurst Road, Case #11 -029 -CU. Approval is recommended by the Community and Economic Development Department. In addition, Petitioner must meet the following conditions: 1. Prior to issuance of the Conditional Use Permit, the Petitioner shall submit a landscape plan providing one tree in the parkway and a minimum 7' -wide landscape buffer along the east property line with shade trees, a minimum of 2 1/2" in caliper, planted on an average of 1 tree per 30' of yard length. The landscape plan shall also provide for plantings the entire length of the property between the parking lot and the sidewalk along Elmhurst Road. 2. Prior to issuance of the Conditional Use Permit the Petitioner shall complete the site improvements indicated on the approved landscape plan or post a cash bond equal to an approved estimate of the total cost of the improvements provided by third party contractor. 3. Prior to occupancy all parking areas shall be surfaced and striped to meet all applicable Building Code hard surface requirements. Senior Planner Mangum answered questions from the Aldermen. Alde-u Bien Brookman and Walsten voted no. 2ND FACADE REBATE REQ./ 733 LEE ST.: Page 7 of 13 9/6/11 Alderman Haugeberg stated that the third item is consideration of the Second Facade Rehabilitation Rebate Request from GARA (Greek American Restaurant Association) at 733 Lee Street. Director of Community & Economic Development Bartholomew gave a brief explanation of the rebate request as outlined in his Memorandum of August 18, 2011 and answered questions from the Aldermen. Alderman Sayad requested more details regarding the number of windows for the invoice submitted for a rebate; he will vote no. Alderman Brookman pointed out that the Petitioner followed the guidelines; can the City dictate the business from which the Petitioner is to obtain a proposal. Alderman Haugeberg stated that there is a balance of $21,570.80 for fiscal year 2011; the Council needs to make a decision on one of the four suggestions proposed by staff on page 2 of the August 18, 2011 Memorandum. Moved by Charewicz, seconded by Brookman, to accept staff recommendation to approve the request in the amount of $30,400.00 and appropriate the entire amount of $30,400.00 to the facade rehabilitation program (total unreserved balance in the Facade Rehabilitation program will continue to be $21,570.80 and the applicant will receive full award amount. Moved by Bogusz, seconded by Sayad, for a substitute motion to DENY the Second Facade Rehabilitation Rebate Request from GARA (Greek American Restaurant Association) at 733 Lee Street (Facade Rehabilitation Program will continue to have $21,570.80 unreserved balance). Mr. Ron Moore, 1480 Jefferson Street, addressed the Committee of the Whole stating that AT&T does generate tax revenue for the City; does the Economic Development Commission follow the By-laws?; he read comments by EDC for this request; there should be another bid for the windows. Mr. Wayne Serbin, 835 Pearson Street, addressed the Committee of the Whole stating that a few months ago the Miner Street Tavern put in new windows; this change would bring in a higher clientele; young professionals would spend more money; he gave an example of a club in downtown Chicago which made changes to its building to attract more business. Mr. Brian Burkross, 2133 Webster Lane, addressed the Committee of the Whole stating that Alderman Sayad has a right to question committees; residents have the right to question the aldermen; he encouraged Alderman Haugeberg to hold Community Development meetings separate from council meetings; why are windows included in the facade program; agrees with Alderman Bogus that this matter should be tabled: give it back to staff; he encouraged aldermen to attend EDC meetings, discuss, then bring back to the Page 8 of 13 9/6/11 733 LEE ST.: Council; he suggested that the Council spend TIF funds wisely. (Cont'd) As requested by Alderman Haugeberg, Director of Community & Economic Development Bartholomew gave an explanation of how this particular request is to be processed by the Council; he is in the process of tightening up the policies. Mr. Burkross understands the four options recommended by staff and the issues; he suggested that this matter be tabled for further review and development by staff. Mr. Ted Ardvanitis, 733 Lee Street, Secretary for the Greek American Restaurant Association, addressed the Committee of the Whole giving a history of how this building was chosen; they spent $1 million dollars to fix it up; the organization has been around for over 20 years; not interested in flipping the building; they followed the rules of the facade guidelines; they want to make Des Plaines better. Mr. Tom Diamond, President of the Greek American Restaurant Association, addressed the Committee of the Whole stating that he does not reside in Des Plaines, but is a business owner; their association is not a tax generating business, but a traffic generating business which will eventually create more business; he thanked the City for the $41,000 applied for earlier. Regarding the substitute motion to DENY the request for reimbursement Second Facade Rehabilitation Rebate Request from GARA (Greek American Restaurant Association) at 733 Lee Street, motion declared carried. Aldermen Brookman, Walsten and Charewicz voted no. AWNING Director of Community & Economic Development Bartholomew addressed the INITIATIVE Committee of the Whole stating that clarification of the existing process needed PROGRAM: to be made with proposed changes and answered questions of the Aldermen. Moved by Bogusz, seconded by Brookman, to TABLE the Awning Initiative Program until the Council has a policy consensus and that staff work with the Committee to come back with a full recommendation for both the Awning Initiative Program and Facade Rehabilitation Program. Moved by Walsten, seconded by Charewicz, for a substitute motion to recommend to the City Council approval of Resolution R-119-11 at appropriate time this evening. Motion declared carried. Aldermen Bogusz and Brookman voted no. ENGINEERING — Alderman Sayad, Chair HOME Alderman Sayad stated that suggestions from the last Council meeting were GENERATOR incorporated into the Home Generator Assistance Program. Acting City Page 9 of 13 9/6/11 ASSISTANCE Manager Slowinski addressed the Committee of the Whole reviewing his PROGRAM: Memorandum of August 22, 2011; the issues raised regarding retroactivity and answered questions from the Aldermen. Alderman Charewicz recommended a waiting period, accept applications and then determine how popular the program is. Motion by Wilson to skip the retroactive period and begin the program on September 12, 2011. Motion DIED for lack of a second. Alderman Brookman suggested changing the retroactivity period to June 15 for those who bought a generator prior to the storm; modify the "first come, first served" to a lottery system which would be fairer; not everyone can be at City Hall at the beginning of the first day. Alderman Walsten does not believe in this program; he and his neighbor should not be buying half of his neighbor's generator; it is fiscally irresponsible. Mr. Brian Burkross, 2133 Webster Lane, addressed the Committee of the Whole stating that his home flooded for the first time; current plan does not address fraud; in his opinion, there are three issues: (1) do you have a generator; (2) verify that a person has a generator; and (3) show need (provide proof); the lottery should show most in need; fairest way to help people; he is against fraud. Mr. Dan Whisler, 1645 E. Walnut, addressed the Committee of the Whole stating that he owns a generator; he reviewed the mechanics of a generator; will safety or training be provided to a resident; the Council needs to create a standard for the type of generator; he would like to see a better definition for the program; research should be done to determine the type of generator required and sound level; the program should have enough money to operate. Ms. Susan Czach, 1669 Illinois Street, addressed the Committee of the Whole stating that since the Council is using taxpayer dollars for this program, shouldn't all the taxpayers be included?; the City should conduct a survey through the water bill; determine how many people have purchased a generator before determining how much money would be put into the program before allocating money. Mr. Ron Moore, 1480 Jefferson Street, addressed the Committee of the Whole stating that this program as introduced is a bigger bucket of worms than the facade issue; people will be discriminated against if they don't need a generator; this is a real invitation to greed and fraud; the money will run out fast; what line item will be used; a bad system all around and should not be introduced. Mr. Gilbert Young, 1441 South Wolf Road, addressed the Committee of the Whole stating that he bought a standby generator; he is interested in applying for the program; it is scheduled to start Monday; by the time he leaves tonight's GENERATOR ASSISTANCE PROGRAM: (Cont' d) AMBULANCE SVC. FEE AMENDMENTS: FEMA FIRE ACT GRANT/EOUIP. PURCHASE: Page 10 of 13 9/6/11 meeting, will he know how to apply. Alderman Charewicz agrees with Mr. Whisler's idea of providing safety instruction to the residents. Motion by Robinson to adopt Resolution R-112-11. Motion DIED for lack of a second. Motion by Brookman to adopt Resolution R-112-11 with a retroactive date of June 15, 2011, the program to start on September 19, 2011 at 8:30 a.m. and adding a lottery system. PUBLIC SAFETY — Alderman Walsten, Chair Fire Chief Wax addressed the Committee of the Whole reviewing his Memorandum of August 23, 2011 regarding ambulance fees and answered questions from the Aldermen. The Public Safety Committee recommends approval by the Council of the proposed amendments to the ambulance service fee levels and providing for "insurance -only billing" for Des Plaines residents. Moved by Haugeberg, seconded by Robinson, to recommend to the City Council approval of Ordinance M-39-11 at appropriate time this evening. Motion declared carried. Mr. Wayne Serbin, 835 Pearson Street, addressed the Committee of the Whole stating that he is a senior citizen; there has not been a raise in Social Security in two years; investments are not doing well and are going down; the price of everything is going up; this would benefit senior citizens. Fire Chief Wax addressed the Committee of the Whole reviewing his Memorandum of August 23, 2011 regarding consideration of a ladder truck grant which would cover 80 percent of the cost; he is asking for the Council's approval to provide 20 percent local match in an amount of up to $250,000.00. Staff contacted Arc Disposal, the City's refuse contractor, and requested additional services to removal the debris deposited in the parkways. These additional emergency services were provided by Arc for a period of two weeks resulting in an additional 653 tons of debris collected. The prompt removal of debris from parkways is critical as it may pose a health and safety hazard. The method of measurement and billing is consistent with the debris collection by Arc Disposal after the August 2007 and September 2008 storms. Specifically, the City is invoiced based on additional hours worked (trucks and employees) and additional tons of material collected. The additional amounts are determined by comparing the number of hours and tons during the special collection period to the average weekly amount from the previous four weeks. Recommendation: We recommend approval of the additional emergency services provided by Republic Services (Arc Disposal), 2101 South Busse Road, Mount Prospect, Illinois 60056, for the removal of flood debris in the amount of $95,316.00. Source of funding would be the 2011 General Fund. Analysis: The Brzozowski's request to connect into our water main is a result of flooding and possible contamination of water from their private well during flooding conditions. The City owns and operates a 10" diameter water main along the south side of Gregory Street. The Brozowski's residence is located at the northwest corner of Gregory Street and Graylynn Drive. Our City corporate limit is the north line of the Gregory Street right-of-way as shown on the attached exhibit. Two unincorporated residential properties along the north side of Gregory Street (101 and 103 Gregory) currently are connected to City of Des Plaines water and billed at twice the retail rate as City residents. This location would be billed at this same rate. Looking forward, 18 additional properties are similarly situated, having private wells along the north side of Gregory Street in unincorporated Wheeling Township. Third Avenue, Des Plaines, IL In reviewing this variation request, staff has considered the following information: The 55' by 130' lot (7,150 square foot), at 1225 S Third Avenue is a legal conforming lot. A one story frame residence with aluminum siding with a driveway and detached rear garage currently exists on site. The applicant has proposed to demolish and replace the existing approximately 20' by 20' garage with a new 720 square -foot garage (24' x 30'). The proposed garage would be located 3' 6" from the south property line, the same as the existing garage. As proposed the building height of the garage measures approximately 12' 9", the average between the eaves (approximately 8') and ridge level (17' 6"). This would comply with the maximum height allowed for an accessory structure of 15' to the midpoint. However, the height of the house is 15' 6" to the ridge and 11' 10 1/2" to the midpoint. Section 8.1-1-C of the Zoning Ordinance requires an accessory structure to be subordinate in height to the primary structure. A variance has been requested because the proposed garage would be taller than the house. The applicant has stated that he is seeking additional storage space, due to flooding of basement storage areas in the house. Recommendations: Staff recommends denial of the requested variation for an accessory structure that is taller than the primary structure based on review of the information presented by the applicant and the standards and conditions imposed by Section 3.6-8 (Findings of Fact for Variations) as outlined by the City of Des Plaines Zoning Ordinance. Staff does not believe that there is a hardship that justifies an accessory structure to be taller than the house. The height of the structure is somewhat out of character in the neighborhood filled with predominantly one to one and a half story primary structures with garages that are generally subordinate in height. The ZBA recommended against, and the City Council denied, a similar request at 1115 E. Grant Avenue earlier this year. At its September 13, 2011 meeting the Zoning Board of Appeals approved (4-2) a requested 3'6" side -yard setback request and recommended (4-2) that the City Council approve the above- mentioned variation for an accessory structure that is taller than the primary structure in the R-1 zoning district. Under Section 3.6-7 of the Zoning Ordinance (Major Variations) the City Council has the authority to approve, approve subject to conditions, or deny the above-mentioned variance for an accessory structure that is taller than the primary structure in the R-1 zoning district. Every time it rains, all the water runs towards his house and it (the basement) floods, ruining personal belongings, etc. Cannot use the attic because it will not support the weight. Therefore, he needed enough garage space so that they can walk up the stairs so that they can store personal belongings. There are other garages in the area that are the same as what he wants to build. Chairman Seegers asked if it would be a frame construction garage. Mr. Powal stated it would be frame construction with dry wall which would be fire rated. Board Member Saletnik asked about the other locations of garages similar to what petitioner wanted to build and if they were approved. Mr. Mangum stated that there was a variance for at least one of those garages. Mr. Powal stated that the actual garage which is identical to the one shown on attachment 3. Board Member Saletnik stated that the garage would also have a gambrel roof. Mr. Powal stated it would. Board Member Porada asked if the garages were the same as the proposed garage regarding the height of the garage. Mr. Mangum stated that he was not sure and could not tell from the field survey. Chairman Seegers asked why the garage doors would be 8' high instead of the norm of 7'. Mr. Powal explained that his existing garage door had to be adjusted to a 7.5' height in order to fit his van and Ford Explorer, which are taller than the norm of 7'. Third Avenue, Des Plaines, IL In reviewing this variation request, staff has considered the following information: The 55' by 130' lot (7,150 square foot), at 1225 S Third Avenue is a legal conforming lot. A one story frame residence with aluminum siding with a driveway and detached rear garage currently exists on site. The applicant has proposed to demolish and replace the existing approximately 20' by 20' garage with a new 720 square -foot garage (24' x 30'). The proposed garage would be located 3' 6" from the south property line, the same as the existing garage. As proposed the building height of the garage measures approximately 12' 9", the average between the eaves (approximately 8') and ridge level (17' 6'). This would comply with the maximum height allowed for an accessory structure of 15' to the midpoint. However, the height of the house is 15' 6" to the ridge and 11' 10 1/2" to the midpoint. Section 8.1-1-C of the Zoning Ordinance requires an accessory structure to be subordinate in height to the primary structure. A variance has been requested because the proposed garage would be taller than the house. The applicant has stated that he is seeking additional storage space, due to flooding of basement storage areas in the house. In summary, two variations are requested: to allow an accessory structure, the garage, with a 3' 6" side yard setback, instead of not less than 5'; and to allow an accessory structure that is taller than the primary structure. Recommendation: Staff recommends approval of the requested side -yard setback variation and denial of the requested variation for an accessory structure that is taller than the primary structure based on review of the information presented by the applicant and the standards and conditions imposed by Section 3.6-8 (Findings of Fact for Variations) as outlined by the City of Des Plaines Zoning Ordinance. The side yard setback variance request would maintain the existing setback where compliance with the 5' side -yard setback would further impact the tight area for vehicle movements between the house and garage. However, staff does not believe that there is a hardship that justifies an accessory structure to be taller than the house. The height of the structure is somewhat out of character in the neighborhood filled with predominantly one to one and half story primary structures with garages that are generally subordinate in height. The ZBA recommended against, and the City Council denied, a similar request at 1115 E. Grant Avenue earlier this year. Zoning Board of Appeals Procedure: The Zoning Board of Appeals has final authority for the side -yard setback variation request. tinder Section 3.6-7 of the Zoning Ordinance (Major Variations) the Zoning Board of Appeals has the authority to recommend that the City Council approve, approve subject to conditions, or deny the variance for an accessory structure that is taller than the primary structure. The City Council has the final authority on the project. Board Member Porada asked how long he had lived in the house, type, and basement. Mr. Powal stated 37 years, ranch, and basement. Board Member Porada asked if the basement flooding was the only reason, or if was that they needed the space. Mr. Powal stated both. Chairman Seegers asked for comments from the audience. Michael Goldstein, 1216 S. third, stated that he was in favor of it. Mr. Goldstein moved into his house 18 years ago, Mr. Powal has been a good neighbor. Mr. Goldstein stated that when his house flooded, he also experienced the loss of personal possessions and furniture from the flooding. Most of the people in the neighborhood had a problem with storage as well. Mr. Mangum stated that he received a letter from Margaret Ann Wolframs giving support for this project. Board Member Porada stated that there were 2 requests. 1 for the side -yard setback of 3'6" where the minimum is 5' with staff recommending approval, but staff recommends denial of the height of the structure. He asks that they consider staff's recommendation to deny the proposal. Board Member Porada reviewed the standards; stated that the height would change the character, that flooding was not unique, and that inadequate storage was not a hardship that should allow the variation. Board Member Hotherr asked about the height of the garage and storage. Would the petitioner be able to have storage in the garage above where the vehicles are parked without having to ask for a variance. Mr. Powal stated that it would be very hard to carry things in and out of the garage. Board Member Saletnik stated that after looking at attachment 3, all the garages seem to have the additional storage space and was not out of character for the area. The hardship of storage was always an issue and common to households today. He stated that as long as it would be in character of the neighborhood he would agree with it. Board Member Szabo stated that it seemed that you could not put anything of value in the basement in homes in Des Plaines because of the flooding. He would be agreeable to approve. Commissioner Catalano stated that he would approve because it would not affect the character of the neighborhood and the field work could not tell that the garages were bigger. Board Member Hofherr asked about other homes. Mr. Powal stated there were six homes on his block and all had smaller yards. Board Member Hofherr stated that if it were allowed, it would be the tallest structure of the block. Mr. Powal spoke with all his neighbors and across the street all had given him their approval. Chairman Seegers asked if his property sloped. The backyard to his house was flat but sloped (3' drop) from his house to the street. Board Member Saletnik asked that two separate motions be made. A motion was made by Board Member Saletnik, seconded by Commissioner Catalano for approval of a variation to Sections 8.1-3-C with a side -yard setback of 3'6", where the minimum side -yard setback allowed is 5' for an accessory structure in the R-1 zoning district. Slowinski, Acting City )4,0;4; Additional Funding for the Home Generator Assistance Program Issue: The City Council approved the Home Generator Assistance Program via R-112-11 at its September 6, 2011, regular meeting with an initial funding amount of $22,500. The program was implemented on Monday, September 19th. The initial funding amount was exhausted the first day of the program and the City Council should discuss whether to extend additional funding for the program. Analysis: During the first week of the Home Generator Assistance Program (September 19 - September 23) the City received a total of 379 applications with 82 being approved to receive funding. The breakdown of applications received is as follows: Retroactive Applications ($7,500) New Applications ($15,000) Totals Applications Rec'd 170 209 379 # of Approved 27 55 82 a Staff estimates that an additional $82,000 would be necessary to fund all of the remaining 297 applications, notwithstanding any new applications that are received after the date of this report. Since the Home Generator Assistance Program was not a budgeted item in the 2011 Budget, any additional funding extended to this program during FY 2011 would be allocated from fund balance dollars in the General Fund. Recommendation: Staff recommends an additional $50,000 be allocated to the Home Generator Assistance Program in FY 2011 and, of that amount, $30,000 is reserved for new applications and $20,000 is reserved for retroactive applications. Staff also recommends that any additional funding beyond the recommended amount of $50,000 be discussed during the 2012 Budget and included for funding in FY 2012. w/ Attachment: Resolution R-135-11 CITY OF DES PLAINES RESOLUTION R - 135 - 11 A RESOLUTION AUTHORIZING ADDITIONAL FUNDS FOR THE HOME GENERATOR REIMBURSEMENT PROGRAM FOR THE CITY OF DES PLAINES. WHEREAS, on September 6, 2011, by Resolution R-112-11, the City Council adopted the Home Generator Reimbursement Program to help subsidize the purchase of generators by residents to be used during periods of power outages; and WHEREAS, a total of $22,500.00 was allocated for the program; and WHEREAS, over three hundred residents applied for the reimbursement and there was only enough budgeted funds to reimburse the first 82 applicants; and WHEREAS, adding $50,000.00 to the Home Generator Reimbursement Program would benefit the remainder of the applicants, as well as residents who have yet to apply; and WHEREAS, it is in the best interest of the City to add $50,000.00 of additional funds to the Home Generator Reimbursement Program for the City of Des Plaines to help subsidize the purchase of generators by residents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Des Plaines, Cook County, Illinois in the exercise of its home rule powers, as follows: SECTION 1: That the recitals set forth herein above are incorporated herein by reference as the factual basis for this transaction.
