CALL TO ORDER: The Special meeting of the City Council of the City of
Des Plaines was called to order by Mayor Martin J.
Moylan at 7:00 PM in Room 102, Des Plaines Civic
Center on Tuesday, November 13, 2012.
ROLL CALL:
Roil call indicated the following Aldermen present:

BUDGET: for the Final 2013 Budget document based on the consensus

deliberations; the annual budget totals $126.1M
(excluding transfers) or a $13.6M (12.09%) increase over
the 2012 budget.
Moved by ::augeberg, seconded by Robinson, to approve a
reduction in the budgeted amount from $395,000 to
$115,000, for Video Camera and Interface for the C. y
Hall City Council Chambers. Upon roll call, the vote

MAYOR MOYLAN DECLARED THAT THE CITY COUNCIL WAS NOW
RESOLVED INTO A COMMITTEE OF THE WHOLE
WATER BILL Director Finance Wisniewski reviewed the memo of November
AMNESTY 1, 2012 regarding the City Council's interest in
PROGRAM: establishing a procedure for dealing with water meter
reading discrepancies resulting from inaccurate reads
from the City's meter reading equipment; Staff is
recommending that the resident be billed at the current
City of Chicago water purchase rate which a' ows the
equipment to be replaced within the place of residence
and also for the City to be able to recoup the cost of
the water used which has already been paid to the City of
Chicago.
Moved by Bogusz, seconded by Robinson, that Staff be
authorized to proceed as directed regarding Water Meter
Amnesty authorizing Option 4 of the Water Meter Amnesty
Program, which is defined as charging property owners the
Unit Price for each unit of Under -Recorded Water at the
Unit Price that the City of Chicago charges the City of
Des Plaines at the time the discrepancy is discovered for
Under -Recorded Water; a payment plan be offered and that
the Program is retroactive for those residents who are
currently on a payment plan; that Staff update the City
Council on an annual basis during the budget process; and
Resolution R-139-12, as amended, be adopted at
appropriate time this evening.
Moved by Walsten, that the Water Meter Amnesty Program be
retroactive twenty-four (24) months from this date.
Motion DIED for lack of a second.
Moved by Walsten, seconded by Bogusz, to call for the
question. Motion declared FAILED. Aldermen Bogusz and
Walsten voted aye. Aldermen Haugeberg, Robinson, Sayad,
Brookman and Charewicz voted no.
Mr. Al Brown, 675 Pearson Street, addressed the Committee
of the Whole stating that a meter reading s:ould be
completed for each household; what is the cost to
complete.
Motion declared carried on the original motion. Aldermen

Director of Public Works and Engineering Oakley reviewed
his memo of October 30, 2012 regarding the purchase of
water meter and automated meter reading equipment; Staff
is recommending the purchase of the Sensus Automated
Meter Reading equipment, water meters and repair parts
from HD Supply -Waterworks in the amount of $260,000 in
2012 and $160,000 in 20"3.
Moved by Sayad, seconded by Robinson, to authorize Staff
to purchase the Sensus Automated Meter Reading equipment,
water meters and repair parts from their authorized
distributor, HD Supply -Waterworks, 220 South Westgate
Drive, Carol Stream, IL 60188 for the 2012 calendar year
in the amount of $260,000 and for the 2013 calendar year
in the amount of $160,000; source of funding is budgeted
2012 Water Funds and the 2013 Water Fund; and further
recommend that Resolution R-140-12, as amended, be
adopted at appropriate time this evening.
Mr. Al Brown, 675 Pearson Street, addressed the Committee
of the Whole stating that new water meters sound like a
great idea; there's no guarantee that these meters will
work forever.
Mr. Jerry Plodke, HD Supply Waterworks, 220 South
Westgate Drive, Carol Stream, IL 60188, answered
questions from the Aldermen.
Moved by Walsten, seconded by Sayad, to call for the
question. Motion declared carried. Aldermen Brookman
and Wilson voted no.

ELEANOR ROHRBACH MEMORIAL COUNCIL CHAMBERS%
DES PLAINES CIVIC CENTER, MONDAY. NOVEMBER 19, 2012
Mayor Moylan called the Public Hearing to order at 7:03 p.m. The Public
Hearing was being held pursuant to legal notice (published in the local
newspaper on Wednesday, November 7, 2012) to discuss the proposed property
tax levy increase for the City of Des Plaines for 2012 tax year levy in the
amount of $29,346,860.00. This represents a decrease of 3.23% from 2011 (a
0% increase).
Director of Finance Wisniewski reviewed her Memorandum of October 31,
2012 which outlined the primary aspects of the 2012 estimated tax levy.
Mayor Moylan asked for comments from the aldermen and the public.
M . Brian Burkross, 2 33 Webster Lane, addressed the City Council asking
questions of Director of Finance Wisniewski regarding the 2011, 2012 and
2013 tax levies. Director of Finance Wisniewski responded to Mr. Burkross'
questions. Mr. Burkross stated that he is disappointed that no one on this
council made a motion to kick back 10 or even 20% to the residents; over the
last 4 or 5 years we have done a good job managing our debt; this means we
paid down debt as we should and did not increase it; general fund and other
funds have increased; at a time people when are struggling to pay their
mortgages, losing their homes, feeding their families, this City has turned a
situation around; the City will still have an abundance of money without
sacrificing any projects and nothing was given back to the residents; he thinks

Fire Chief Wax reviewed a Memorandum dated November 1, 2012 regarding
amendments to the Board of Fire and Police Commissioners Rules and
Regulations as a result of recent legislation. Mr. Arthur Lukowicz addressed
the Committee of the Whole commending Fire Chief Wax and Commissioner
Debbie Lester for their hard work in making the revisions.
Fire Chief Wax answered questions from the Aldermen.

LEGAL AND LICENSING — Alderman Robinson, Chair
Alderman Robinson stated that about a month ago residents brought
documentation (ordinances from surrounding cities) to the Legal and Licensing
Committee and requested that the number of dogs allowed be increased from 3
to 4. Based on the recommendation of Animal Control and Police Chief
Kushner, increasing the number of adult dogs per household from 3 to 4 would
not pose any hazard or be detrimental to the citizens of Des Plaines.
Moved by Sayad, seconded by Walsten, to recommend to the City Council
approval of an ordinance amending Title 6 of the City Code relating to the
number of dogs from 3 to 4 in a "single family detached residence".
City Manager Bartholomew asked for clarification regarding the number of
dogs allowed for condominiums compared to single family residences.
Following discussion, the ordinance will be amended to increase the number of
dogs from 3 to 4 for a "single family detached residence".
Mr. Brian Burkross, 2133 Webster Lane, addressed the Committee of the
Whole questioning the number of pets allowed and requested that this be

Mr. Wayne Serbin, 835 Pearson Street, addressed the Committee of the Whole
stating that he doesn't have any dogs; we have multi -family condominiums;
Naperville's ordinance allows two dogs; why can't we have a strict ordinance.

Director of Community & Economic Development Dambach reviewed a
Memorandum of October 30, 2012 submitted by Senior Planner Mangum
regarding a request from Petitioner Good Shepherd Lutheran Church located at
1177 Howard Street (Zoning Case #12 -059 -MAP) for an Amendment to the
Official Des Plaines Zoning Map, as amended, to reclassify the property from
the R-1 Single Family Residential Zoning District to the I-1 Institutional Zoning
District.
Mr. Lee Henson, 1177 Howard Street, representing the Petitioner, addressed the
Committee of the Whole regarding the request for an Amendment to the
Official Des Plaines Zoning Map and answered questions from the aldermen.

approval of an amendment to the Official Des Plaines Zoning Map, as

Mr. Brian Burkross, 2133 Webster Lane, addressed the City Council stating that
there would be a committee meeting after the October 30 budget hearing; this
will be a huge expense; he logged into the Internet and found parts and whole
units of water meters which solves the immediate emergency of replacement;
the City could do more and be aware of the some of the issues going on; he read
how reliable these meters are and information is available; isn't there a hybrid
approach.

Re: Special Service Areas (SSA) 2012 Tax Levy Ordinances
Issue: Staff requests the City Council consideration of the 2012 Tax Levy Ordinances related to
Special Service Area #5, 6, 7, 8, 9,10,11,12, 13, and 14.
Analysis: Special service areas are typically created to provide special services in addition to those
generally provided throughout the municipality. Within each special service area additional taxes
are imposed on the individuals who are provided the additional service.
Cook County requires City Council adoption and filing of a property tax levy ordinance to collect
the levy amount attributable to the respective properties within the aforementioned SSA's for
completed projects that were not funded by bonds. In addition, the County requires that an
ordinance be adopted and filed annually for each SSA's levy during the term of the SSA. The
following provides a listing of all of the Special Service Areas and the amounts to be levied in the
upcoming property tax levy:

Recorder of Deeds as Document #0319703000; and
WHEREAS, Ordinance M-30-03 states that there will be an annual tax levy not to exceed
$5,650 for the tax years 2003 through 2018, for the payment of the special services of installing an
8" water main, completed at a cost of $41,325, with an interest repayment cost of $15,406, for a
total amount to be collected for tax years 2003 through 2017 of $56,731, which equals fifteen
annual tax levies of $3,782;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Des
Plaines, Cook County, Illinois, in the exercise of its home rule powers, as follows:

WHEREAS, the Corporate Authorities of the City of Des Plaines adopted Ordinance M-
73-04 on November 15, 2004, creating Special Service Area Number Six, being recorded with the
County Recorder of Deeds as Document #0514727137; and
WHEREAS, Ordinance M-73-04 states that there will be an annual tax levy not to exceed
$1,050 for the tax years 2004 to 2019, for the payment of the special services of reconstruction and
improvement of the area's parking lot at a cost of $9,932, that has an interest repayment cost of
$3,797, for a total amount to be collected for tax years 2005 through 2019 of $13,729, which equals
fourteen annual tax levies of $981 for tax years 2005 through 2019;

Re: Tax Levy Abatement Ordinances
Issue: Staff requests the City Council adoption of the 2012 Tax Levy Abatement Ordinances for
the below listed General Obligation Bonds.
Analysis: Each year the City adopts several tax abatement ordinances to reduce the amount of
property taxes levied for various bond issues. During the initial issuance of these General
Obligation Bonds the plan was that alternative revenue would be established, or designated, and
used to pay the annual debt service. The following is a brief summary of the abatement ordinances
proposed for 2012:
Abatement of the 2003C Taxable General ObL'gation Bonds
This ordinance abates or cancels the entire property tax levy ($213,917.50) for the 2003C Taxable
General Obligation Bonds. TIF #6 funds will be used as the alternative revenue for payment of the
annual debt service. The 2003C issue was used for land acquisition in TIF #6.
Abatement of the 2004A and 2004B General Obligation Bonds
This ordinance abates or cancels the entire property tax levy for the 2004A ($735,743.76) and
2004B ($796,907.50) General Obligation Bonds. The 2004A issue was used to pay the costs of
land acquisition and infrastructure improvements within TIF #1 and to construct improvements to
City streets and roads. The 2004B issue was used to pay the costs of a lease buyout and soft costs
(architectural, engineering and legal fees) within TIF #6.
Abatement of the 2005A and 2005C General Obligation .Bonds
This ordinance abates the total property tax :evy as follows: ($:32,825.00) for 2005A and
($379,600.00) for 2005C. TIF #3 funds will be used to pay the debt service for the 2005A Bonds,
which were issued for a developer payment pursuant to the TIF #3 phase one development
agreement. Water funds were used to pay the debt service for the 2005C Bonds, which were issued
to refund the 1997B Water Fund Bonds.

Abatement of the 2005D General Obligation Bonds
This ordinance abates the total property tax levy ($1,693,460.00) and the Capital Projects Fund
funds will be used to pay the remaining debt service. These bonds were issued to refund the 1998
General Obligation Bond issue. The 1998 issue was used to pay for library construction, street
improvements and sewer improvements.
Abatement of the 2005E, 2005F and 2005G GO Bonds
This ordinance abates the total property tax levy as follows: ($694,126.26) for 2005E,
($510,550.00) for 2005F, and ($41,625.00) for 2005G. TIF #1 and Capital Projects funds will be
used to pay the debt service for the 2005E Bond. TIF #1 Funds will be used to pay the debt service
for the 2005F bond. TIF #3 funds will be used to pay the debt service for the 2005G bond.
The 2005E, 2005F and 2005G Bond Series issues were used for parking garage improvements and
TIF land acquisition.
Abatement of the 2007A and 2007B General Obligation Bonds
This ordinance abates the total property tax levy ($802,760.00) for the 2007A GO Bonds. These
bonds were issued for the refunding of the 2000 and 2001 GO Bonds. The 2000 issue was used for
street improvement projects. The 2001 issue was used for street and sewer improvement projects.
The 2007B ordinance abates or cancels that portion ($69,500.00) of the property tax levy
$174,900.00 for the 2007B General Obligation Bonds. TIF #1 funds will be used as the alternative
revenue for payment of the annual debt service. The 2007B issue was used for refunding of 2001B
GO Bonds. The 2001B issue was used for fire station land acquisition and construction.
Abatement of the 2008A General Obligation Bond
This ordinance abates the total property tax levy ($318,415.00). TIF #1 and TIF #3 funds will be
used as the alternative revenue for payment of the annual debt service. The 2008A issue was used
for refunding of 2001C GO bonds, which were originally issued for land acquisition in both TIF #1
and TIF #3.
Abatement of the 2009A Taxable General Obligation Bonds
This ordinance abates the total property tax levy ($170,000.00) for the 2009A Taxable General
Obligation Bonds. The 2009A issue was utilized to restructure debt service costs within TIF #6 and
will be funded by TIF #6 revenues.
Abatement of the 2009B General Obligation Bonds
This ordinance abates the total property tax levy ($924,750.00) for the 2009B General Obligation
Bonds. These bonds were issued to refund the 1999 General Obligation Bond issue. The 1999 issue
was used for the library construction project. The Capital Projects Fund, with its alternative revenue
sources, will be used to abate this issue.
Abatement of the 2010A and 2010B General Obligation Refunding Bonds
This ordinance abates or cancels the entire property tax levy for the 2010A and 2010B
($156,003.76) General Obligation Refunding Bonds. The 2010A and 2010B issues were utilized to
restructure debt service costs within TIF #3 and will be funded by TIF #3 revenues.

Abatement of the 2011 General Obligation Refunding Bonds
This ordinance abates or cancels the entire property tax levy for the 2011 ($347,362.50) General
Obligation Refunding Bonds. The 2011 issue was utilized to restructure debt service costs within
TIP #1, TIF #3, TIF #5 and TIF #6 and will be funded by TIF revenues.
Recommendation: Staff recommends that the City Council approve the property tax abatements
which will result in a reduction to the 2012 Property Tax Levy.

WHEREAS, the Corporate Authorities of the City of Des Plaines adopted Ordinance M-
43-03 entitled "Ordinance Authorizing the Issuance of General Obligation Bonds, Series 2003A,
and Taxable General Obligation Bonds, Series 2003C, of the City of Des Plaines, Illinois" on
August 4, 2003, which provided for the issuance of $7,835,000.00 Series A and $2,250,000 Series
C Taxable General Obligation Corporate Purpose Bonds; and
WHEREAS, Ordinance M-43-03 provided for the levy of taxes for the tax year 2012
sufficient to produce the amount of $638,230.00 and $213,917.50 for the payment of principal and
interest respectively on said bonds; and
WHEREAS, The City of Des Plaines has previously filed with the County Clerk of Cook
County, Illinois, a certificate entitled "Second Certificate of Reduction of Taxes Heretofore Levied
for the payment of General Obligation Bonds, Series 2003A, of the City of Des Plaines, Illinois"
abating all of the remaining tax levies for the Series 2003A General Obligation Bonds; and
WHEREAS, sufficient TIF Funds are available to abate the annual levy for the principal
and interest on the Series 2003C General Obligation Corporate Purpose Bonds for the tax year
2012;
NOW, THEREFORE, BE IT ORDAINED by the Corporate Authorities of the City of

WHEREAS, the Corporate Authorities of the City of Des Plaines adopted Ordinance M-
44-09 entitled "Ordinance Authorizing the Issuance of General Obligation Refunding Bonds, Series
2010A and Series 2010B, of the City of Des Plaines, Illinois" on November 16, 2009, which
provided for the issuance of $3,945,000.00 Series 2010A General Obligation Refunding Bonds and
$6,110,759.50 Series 2010B General Obligation Refunding Bonds; and
WHEREAS, Ordinance M-44-09 provided for the levy of taxes for the tax year 2012
sufficient to produce the amount of $156,003.76 for Series 2010A General Obligation Refunding
Bonds for the payment of principal and interest on said bonds; and
WHEREAS, Ordinance M-44-09 does not provide for the levy of taxes until the tax year
2016 for Series 2010B General Obligation Refunding Bonds; and
WHEREAS, sufficient TIF Funds are available to abate the annual levy for the principal
and interest on the Series 2010A General Obligation Refunding Bonds for the tax year 2012;
NOW, THEREFORE, BE IT ORDAINED by the Corporate Authorities of the City of
Des Plaines, Cook County, Illinois as follows:
SECTION 1: That the recitals set forth above are incorporated herein by reference and
made a part hereof, the same constituting the factual basis for this Ordinance.
SECTION 2: That the following amount of taxes to be levied for the Series 2010A

Re: 2012 Property Tax Levy
Issue: Presented for City Council approval is the 2012 Tax Levy representing a 0.00% increase
from the 2011 Tax Levy.
Analysis: The Illinois Property Tax Extension Limitation Law (PTELL) requires that the City adopt
a tax levy ordinance and file it with the County Clerk's office by the last Tuesday in December
(Monday, December 24 for 2012, given the holiday on Tuesday the 25th). The PTELL also requires
that the tax levy ordinance be accompanied with the estimated amounts appropriated or budgeted
and the amount of tax levied for each fund.
The 2012 Estimated Tax Levy is scheduled for first reading on November 19 (in conjunction with
the public hearing on the Tax Levy) and second reading on December 3. Should the City Council
decide that further review of the Tax Levy is required; the second reading of the Tax Levy can be
postponed to December 17. However, the County Clerk's office filing deadline of December 24
remains firm and it is imperative the City Council adopt a tax levy of some amount on the
evening of December 3 or December 17, or the City would be prohibited from levying any
property tax.
The 2012 Estimated Tax Levy, which includes the general (corporate) fund, police and fire pension
funds, public library fund, and bond & interest (debt service) fund, totals $29,346,860. This
represents a 0.00% increase from the 2011 Tax Levy and a 3.23% decrease over the 2011 Tax
Extension. Table 1 depicts a detailed comparison of the 2011 Tax Extension and the 2012
Estimated Tax Levy:

DES PLAINES, COOK COUNTY, ILLINOIS FOR THE
FISCAL YEAR BEGINNING JANUARY 1, 2013 AND
ENDING DECEMBER 31.2013.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES,
COOK COUNTY, ILLINOIS IN THE EXERCISE OF ITS HOME RULE POWER, AS
FOLLOWS:
SECTION 1: That a tax in the sum of $29,346,860 (Twenty -Nine Million, Three Hundred
Forty -Six Thousand, Eight Hundred Sixty Dollars) being the total estimated appropriation
heretofore legally made, or so much thereof as may be authorized by law, which is to be collected
from the 2012 tax year levy for all Corporate purposes of the City of Des Plaines, including but not
limited to, the maintenance of the Des Plaines Free Public Library, and Police and Firefighter
Pension Funds as appropriated for the fiscal year by the ANNUAL APPROPRIATION
ORDINANCE OF THE CITY OF DES PLAINES, duly passed by the City Council of the said City
of Des Plaines, be and the same is hereby levied for said purposes against all taxable property in the
City of Des Plaines for the fiscal year commencing January 1, 2013 and ending December 31, 2013.
SECTION 2: The specific amounts as levied for the various purposes heretofore named

Issue: During the November 19th City Council Meeting, the City Council approved Ordinance M-
57-12 for the 2012 Series Refunding Bonds. At the December 31d City Council meeting the
Ordinance will be presented as Amended on Second Reading under the Consent agenda.
Analysis: The 2012 Series Bond sale will occur the morning of December All of the bond
schedules will be compiled and the Ordinance will be updated with the final numbers. The
Ordinance as Amended will be presented to the City Council during the meeting.
Recommendation: Staff recommends that the City Council pull Ordinance M-57-12 As Amended
off the Consent Agenda On December 31d and approve the final version of the Ordinance.

Issue: To refinance a remaining portion of the General Obligation (G.O.) Bonds, Series 2004A and
pay off the bond and interest portion of the Capital Projects Fund debt utilizing gaming tax revenue
transferred into the Capital Projects fund.
Analysis: Interest rates are at historically low levels creating a favorable opportunity for the City to
utilize bond refinancing as an important debt management tool to achieve interest cost savings,
reduce the outstanding debt and restructure the stream of debt service payments. The G.O. Bonds,
Series 2004A issue satisfies all the necessary criteria to undertake this refunding.
Table 1 below summarizes the G.O. Bonds, Series 2004A outstanding balances after December 1,
2011 payments as well as the funding sources and maturity dates.

Benchmarks: When evaluating the pertinence of the debt refunding, the following three key
benchmarks must be taken into consideration in making a decision:
• Net present value (NPV) savings (net of all issuance costs and any cash contribution to the
refunding) should be at least 3-5 percent of the refinanced bonds.
• Present value savings must exceed twice the costs of the issue.
• There should be no extensions to existing maturity dates.
Early Payoff: Since a portion of this issue was used to finance street and road improvement
projects, staff recommends utilizing "gaming tax revenues" as discussed during budget deliberations
and call the remaining balance of $1.165M on January 1, 2013. By calling this debt early and
paying it off in January 2013 the City will be able to save approximately $230K in interest
payments. This debt is scheduled to mature on December 1, 2020.
The total amount needed to pay off this debt in January 2013 is estimated at $1,173,172 and would
be funded by gaming tax revenues. Paying this debt early will alleviate approximately $175K in
expenditures within the Capital Projects fund to utilize towards future capital improvements.
Refunding: The remaining $3.8M of G.O. Bonds, Series 2004A was issued for land acquisition
and infrastructure improvements in TIF #1 and streets and roads improvement in the City. The new
G.O. Bonds, Series 2012A will refund the remaining G.O. Bonds, Series 2004A with a total
estimated bond size of $3.820M and December 1, 2020 maturity date.
This $3.820M bond refunding will satisfy all three key benchmarks outlined above:
• NPV savings is projected to be at 11.64% of the refinanced bonds — above the 3% to 5%
recommended amount.
• Present value savings are estimated at $430K - well above the recommended two times the
cost of issuance ($36,000) amount.
• The current December 1, 2020 maturity date will remain unchanged.
An Ordinance to refund the remaining TIF #1 and Capital Projects Fund portions of the General
Obligation Bonds, Series 2004A will be presented to the City Council at the November 19, 2012
meeting for the issuance of General Obligation Refunding bonds, Series 2012A.
Conclusion: It is recommended that the City Council approve on first reading the ordinance
authorizing issuance of $4.89M General Obligation Refunding Bonds, Series 2011A. Attached is a
draft bond ordinance prepared by our bond counsel Katten, Muchin, and Rosenman LLP and
reviewed by issuers counsel Holland and Knight, LLP.

ORDINANCE M - 58 - 12
AN ORDINANCE AMENDING TITLE 6, "POLICE
REGULATIONS," CHAPTER 1A, "DOGS AND CATS," OF
THE DES PLAINES CITY CODE.
WHEREAS, Chapter 1 A of Title 6 of the Des Plaines City Code sets forth various
requirements and regulations governing the keeping and care of dogs and cats in the City; and
WHEREAS, Section 5 of Chapter 1 A of Title 6 requires people who keep more than
three adult dogs in one household to comply with regulations governing dog kennels; and
WHEREAS, the Mayor and the City Council have determined that it is in the best
interest of the City and the public to amend Chapter 1 A to permit residents of the City to keep up
to four adult dogs in one single-family detached dwelling without complying with regulations
governing dog kennels;
NOW THEREFORE, BE IT ORDAINED, by the City Council of the City of Des
Plaines, Cook County, Illinois, in the exercise of its home rule powers, as follows:
SECTION 1: The recitals set forth above are incorporated here by reference.
SECTION 2: Title 6, "Police Regulations," Chapter 1A, "Dogs and Cats," Section 5,
"Dog Kennels," of the City Code of Des Plaines, is amended to read as follows:
"6-1A-5: DOG KENNELS:
Any person who allows more than three (3) dogs, excluding
puppies under three (3) months of age, to be kept in one household of any type other than
a single-family detached dwelling,, as defined in Section 13.3 of the City of Des Plaines
Zoning Ordinance, shall be considered the operator of a dog
kennel:
Any person who allows more than four (4) dogs, excluding puppies under three 13)
months of age, to be kept in one single-family detached dwelling,_as defined in Section
13.3 of the City of Des Plaines Zoning Ordinance, shall be considered the operator of a
dog kennel. For the purpose of this Section 6-1A-5 "single-family detached dwelling"
shall not include, without limitation, any mobile home, as defined in Section 13.3 of the
City of Des Plaines Zoning Ordinance.
Operators of dog kennels shall comply with the following regulations:
A. Fee: The kennel operator shall pay the annual fee set out in section 4-1-6 of this code.
B. Location:
1. The kennel shall be located in premises zoned for business purposes.
2. No kennel shall be permitted within three hundred feet (300') of any dwelling house
unless both the owner and occupant of the dwelling house consent to the same; the
applicant to furnish such consent in writing.
C. Kennel Conditions: All dog kennels shall be kept at all times in a clean and sanitary
condition and dogs kept therein shall be reasonably restrained from annoying the
neighborhood or the general public by barking, yelping or howling.
D. License: A kennel license shall obviate the necessity of procuring individual licenses
for any dogs therein; provided, any such dogs permitted to run at large off of the
kennel's premises must be licensed. The kennel license shall include the name and
address of the owner of said kennel, the location of the kennel and the number of
dogs to be kept in the kennel. The kennel license is nontransferable. Each kennel
license shall be posted conspicuously upon the premises where the kennel is located."
SECTION 2: If any paragraph, section, clause or provision of this Ordinance is held
invalid, the remainder shall continue in full force and effect without affecting the validity of the
remaining portions of the Ordinance.
SECTION 3: This Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form according to law.
