CALL TO The regular meeting of the City Council of the City of Des Plaines, Illinois, was
ORDER: called to order by Mayor Martin J. Moylan at 7:00 p.m. in the Eleanor
Rohrbach Memorial Council Chambers, Des Plaines Civic Center on Monday,
August 20, 2012.
ROLL CALL: Roll call indicated the following Aldermen present: Haugeberg, Robinson
Bogusz, Sayad, Brookman, Walsten, Wilson, and Charewicz.
Also present were: City Manager Bartholomew, Director of Finance Wisniewski, Acting Police Chief
Kozak, Fire Chief Wax, Director of Information Technology Duebner, Director of Public Works &
Engineering Oakley, Building & Property Inspection Supervisor Ehrke, Associate Planner Yu and City
Attorney Wiltse.
PRAYER AND The opening prayer was given by Dr. Nesreen Akhatarkhavari of the Baha'i
PLEDGE: Community of Des Plaines, followed by the Pledge of Allegiance.
CITIZEN Mr. Dick Ohman, Past Commandant/Trustee and Mr. Alfred Kolodziej,
PART.: Commandant of the Marine Corps League, Arlington Heights, acknowledged
the contribution by the City of Des Plaines; Des Plaines is the only city in Cook
County that has supported the Marine Corps League for the past 7 years.
Mayor Moylan and Alderman Sayad were each presented with a plaque of
Appreciation.

he does a :ot of walking throughout Des Plaines; the new sign at Pesche's gives
a good appearance; the Council did a good thing.

City Attorney Wiltse explained that, on Page 13 of the Minutes of the August 6,
2012 Council meeting, the motion to accept the single bid regarding a Rescue
Team Trailer for the Fire Department needed to be clarified to reflect the intent
of the City Council to authorize Staff to purchase the trailer.
Moved by Charewicz, seconded by Haugeberg, that the City Council amend the
Minutes of the August 6, 2012 meeting to reflect the intent of the City Council,
in accepting the bid for a Rescue Team Trailer from Ehrhardt's Trailer Sales,
Inc., in the amount of $14,995.00, to authorize Staff to proceed with the
purchase of that item at that price from the named vendor in the best interest of
the City. Upon roll call, the vote was:

Schaffner & Marx and are not changing the City's policies going forward.

WARRANT Alderman Sayad referred to Page 7 of the Warrant Register asking about the
REGISTER: payment under the Water/Sewer Fund to R & M Software for Software Support
Renewal in the amount of $1,800.00.
Director of Public Works & Engineering Oakley stated that the charge is an
annual renewal fee for the sewer camera software.
Moved by Haugeberg, seconded by Sayad, to recommend to the City Council
approval of the July 16, 2012 — Warrant Register, in the total amount of
$3,592,513.13; and further recommend to the City Council that Resolution R-

POLICE/FIRE Fire Chief Wax reviewed his Memorandum of August 10, 2012 regarding radio
RADIO amplifiers by adding language to the City's Fire Code and answered questions

Committee of the Whole to place on First Reading Ordinance M-29-12, AN
ORDINANCE AMENDING TITLE 10, "BUILDING CODE," CHAPTER 1,
"ENACTMENT," SECTION 5, "ADOPTION OF INTERNATIONAL FIRE
CODE," OF THE CITY CODE OF DES PLAINES. Motion declared carried.
City Attorney Wiltse reviewed his Memorandum of August 13, 2012 explaining
that based on the 2010 Census some of the Ward boundaries will need to be
changed. A proposed Ward Boundary Map was presented. City Attorney
Wiltse discussed the proposed map with several of the aldermen prior to
tonight's meeting.
City Attorney Wiltse answered questions from the Aldermen.
Moved by Charewicz, seconded by Haugeberg, to have a second map designed
to be presented at the September 4, 2012 Council meeting. Motion declared
carried.
City Manager Bartholomew introduced Peter Friedman of Holland & Knight
who will be the City's General Counsel.
Mayor Moylan and the Aldermen thanked City Attorney David Wiltse for his
years of service and wished him well on his retirement.
City Attorney Wiltse recounted his years of serving the City of Des Plaines,
Mayors, Aldermen, staff and residents; he has been the longest serving City
Attorney in the last 50 to 70 years.
Moved by Haugeberg, seconded by Sayad, that the regular meeting of the City
Council adjourn. Motion declared carried. Meeting adjourned at 8:15 p.m.

Issue: Plans and specifications for the 2012 Rear Yard Drainage Improvements - Contract B are
completed and the project is ready for bidding. The work consists of installing rear yard drainage to
help alleviate flooding at the below locations as part of the 2012 Capital Improvement Program.
In 2010, the Rear Yard Drainage program was changed to a cost sharing program (Ord. M-7-10) at
75% City , 25% resident cost. Due to this cost sharing requirement, some of the property owners
have requested the creation of a Special Service Area. At 5% interest, annual tax payments will be
paid per year for 10 years and be levied against the properties to satisfy the debt according to the
Resident Cost Sharing Schedule.
The following locations have requested the creation of a Special Service Area to construct a rear

Analysis: The rear yard drainage improvements help to alleviate flooding that occurs on private
property throughout the city. The scope of work at these locations will consist of a storm sewer
tunneled into the City right of way with catch basins installed to drain a low spot that floods. This
program is part of the Storm Water Master Plan.

Recommendation: We recommend the 2012 Rear Yard Drainage Improvements — Contract B
project be advertised for bid with a return date of September 20, 2012 at 9:00 A.M. Source of
funding would be the Capital Projects Fund.
We also recommend the creation of Special Service Area #14 for the 10 -year term per the
Resident Cost Sharing Schedule. A public hearing for the Establishment of Special Service Area
#14 will be held on September 17, 2012 at 7:00 p.m., at the Des Plaines Civic Center Council
Chambers, 1420 Miner Street, in the City of Des Plaines, Illinois. Payment would be from tax
levy years 2012 through 2021 inclusive. Assuming the SSA is approved, construction of this
segment would occur as part of the 2012 Rear Yard Drainage Improvements — Contract B.

Issue: The attorney for Asbury Court, in conjunction with their expansion and improvement of

WHEREAS, the attorney for Asbury Court in conjunction with their expansion and
improvement of their facility, has approached the City of Des Plaines requesting the City to

Court; and
WHEREAS, the Director of Public Works and Engineering has reviewed the Partial
Release of Easement Agreement and approves of the Partial Release; and
WHEREAS, it is in the best interest of the City to authorize the Director of Public
Works and Engineering to execute a Partial Release of Easement Agreement for an easement
located at Asbury Court;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Des
Plaines, Cook County, Illinois, in the exercise of its home rule powers, as follows;
SECTION 1: That the recitals set forth herein above are incorporated herein by
reference as the factual basis for this resolution.
SECTION 2: That the City Council hereby authorizes the Director of Public Works and
Engineering to execute the Partial Release of Easement Release Agreement for an easement
located at Asbury Court, a copy of which is attached hereto and made a part hereof as Exhibit

PARTIAL RELEASE OF EASEMENT AGREEMENT
THIS PARTIAL RELEASE OF EASEMENT AGREEMENT (this "Agreement") is made
and entered into as of this day of , 2012, by and among WIDEOPENWEST
ILLINOIS, LLC, a Delaware limited liability company, NORTHERN ILLINOIS GAS COMPANY
d/b/a/ NICOR GAS COMPANY, an Illinois corporation, AT&T, Inc., an Illinois corporation,
COMCAST OF ILLINOIS XI, LLC, a Delaware limited liability company, and
COMMONWEALTH EDISON COMPANY, an Illinois corporation (collectively, the "Public
Utilities"), the CITY OF DESPLAINES, a municipal corporation, (the "City", and together with the
Public Utilities and their respective successors and assigns, are collectively referred to as the
"Grantors"), jointly and severally, and DESPLAINES PROPERTY, L.L.C., an Illinois limited
liability company, its successors and assigns (the "Grantee").
WITNESSETH:
A. WHEREAS, Grantee is the owner of a certain parcel of land located in Cook County,
Illinois, more particularly described in Exhibit "A" attached hereto (the "Parcel").
B. WHEREAS, each of Grantors benefit from that certain Five -Foot Public Utility and
Drainage Easement located on the Parcel (the "Public Utility Easement"), recorded in the office of
the Recorder of Deeds of Cook County, Illinois on September 19, 1996 as Document no. 96716993
(the "Plat").
C. WHEREAS, it is the intent of the parties hereto that Grantee would be able to build
and construct permanent structures on and over the Parcel.
D. WHEREAS, it is the desire of the parties to enter into this Agreement to partially
release the grant of the Public Utility Easement reserved to the Grantors in the Plat and to allow the
Grantee to build and construct permanent structures over the Parcel.
NOW, THEREFORE, for and in consideration of the foregoing recitals, releases and grants
set forth herein, and for other good and valuable consideration the receipt and sufficiency of which
are hereby acknowledged, it is agreed as follows:
1. Recitals. The recitals set forth herein constitute an integral part of this Agreement,
evidencing the intent of the parties in executing this Agreement, and describing the circumstances
surrounding its execution. Accordingly, said recitals are, by express reference, made a part of the
covenants hereof, and this Agreement shall be construed in the light thereof.
2. Release of Easement. Grantors hereby release, waive and disclaim all right, title and
interest they may have in and to the easternmost one and one-half feet of the Public Utility Easement
set forth, granted and reserved in the Plat, as depicted on the attached Exhibit B (the "Released
Parcel").
3. Remaining Easement. Grantors right, title and interest over, across and upon that
portion of the Public Utility Easement reserved to Grantors by the Plat and not included within the
Released Parcel (the "Remaining Parcel") remains unaffected by this Agreement.
4. Reservation. Grantee hereby reserves the right to build permanent structures on and
over the Released Parcel, provided that such permanent structures do not interfere with any of
Grantors' rights of access existing from time to time on the Remaining Parcel.
5. Duration. The Remaining Easement shall continue in full force and effect.
6. Modification. The rights created under this Agreement may not be modified or
amended unless such modification or amendment has been reduced to writing, signed by Grantor and
Grantees, and recorded in the Real Property Records of Cook County, Illinois.
7. No Implied Dedication of Easement Parcel: Right to Dedicate. Nothing contained in
this Agreement shall be deemed to constitute a dedication of any property, or any portion thereof, to
any governmental body or agency or to the general public, it being the intention of the parties that
this Agreement shall be strictly limited to the purposes set forth herein.
8. Notices. All notices or communications ("Notices") to be given under or pursuant to
this Agreement shall be in writing, addressed to the parties at their respective addresses as set forth
below, and shall be delivered by U.S. certified mail, postage prepaid, return receipt requested, or
reputable, national, pre -paid overnight delivery service which provides proof of delivery.

Notices shall be effective upon delivery or refusal to accept. The parties may change their
notice addresses from time to time upon written notice to the other and as parties other than the
originally named parties obtain an interest in the Easement Parcel, respectively, or any portion
thereof, subject to the terms and conditions of this Agreement. The transferor party shall advise the
other party of the name and address of the party to receive notice as provided herein, provided that
until such time as the transferor party notifies the other party of any such transferee party or other
change in the address, such other party shall be entitled to continue to rely on the accuracy of the
notice address previously in effect.
11. Headings. The headings herein are inserted only as a matter of convenience and for
reference and in no way define, limit or describe the scope or intent of this document nor in any way
effect the terms and provisions hereof.
12. Entire Agreement. This Agreement constitutes the entire agreement between the
parties hereto concerning the subject matter hereof, and no party has relied upon any statement,
promise or representation not herein expressed.
13. Partial Invalidity. If any provision of this Agreement shall be or become invalid,
illegal or unenforceable in any respect under any applicable law, the validity, legality and
enforceability of the remaining provisions shall not be affected or impaired thereby.
14. Counterparts. To facilitate execution, this Agreement maybe executed in any number
of counterparts as may be convenient or necessary, and it shall not be necessary that the signatures of
all parties hereto be contained on any one counterpart hereof. All executed counterparts of this
Agreement shall be deemed to be originals, but all such counterparts taken together or collectively,
as the case may be, shall constitute one and the same agreement.
15. Applicable Law. This Agreement shall be given effect and constructed by application
of the law of Illinois.
16. Authority. The parties hereto represent and warrant that each party has the appropriate
authority to execute and deliver this Agreement.

Re: Radio Amplifiers
Issue: As you know, earlier there was some discussion regarding the Police and Fire Departments'
abilities to send and receive radio signals within buildings in the City. Additionally, provisions requiring
such communications were included as conditions in some Conditional Use Permits approved by the
Council. The Council directed Staff to draft an ordmance to require the ability for the Departments'
radios to provide communications in buildings throughout the City.
Analysis: Related to the Council's direction to create an ordinance to require these communications, it
should be noted that the current City Code adopts the 2006 International Code Council (ICC) model
building and fire codes, and that newer versions (2009 and 2012) of the model fire codes contain
provisions mandating emergency responder communications.
It is Lie intent of uie CED and Fire Departments to eventually upgrade to the 2012 model codes, however
such will take some time to implement. Therefore, we recommend adopting an ordinance that is based on
the requirement of the 2012 Code related to the emergency responder communications in newly -
constructed buildings. Due to several identified concerns in implementing a similar requirement in
existing buildings, the current proposal is just for new buildings, with efforts to be undertaken to
determine the level of deficiencies that may exist in current buildings so that decisions may be made in
the future on how those should be handled.
The following is proposed language to be added to the City's Fire Code:
Emergency responder radio coverage in new buildings.
All new buildings shall have approved radio coverage for emergency responders within the
building based upon the existing coverage levels of the public safety communication systems of
the jurisdiction at the exterior of the building. This section shall not require improvement of the
existing public safety communication systems.
Exceptions.
1. Where approved by the building official and the fire code official, a wired communication
system in accordance with Section 907.2.12.2 shall be permitted to be installed or
maintained in lieu of an approved radio coverage system.
2. Where it is determined by the fire code official that the radio coverage system is not
needed.
3. In facilities where emergency responder radio coverage is required and such systems,
components or equipment required could have a negative impact on the normal operations
of that facility, the fire code official shall have the authority to accept an automatically
activated emergency responder radio coverage system.
The reference above to Section 907.2.12.2 refers to a specific section of the Fire Code related to high-rise
buildings.
Recommendation: The Fire Department recommends that an agenda item for the Public Safety
Committee be added to the Committee of the Whole portion of the August 20`h City Council meeting so
that this issue may be discussed and the attached Ordinance be considered.

the exterior of the building. This section shall not require improvement of the existing public safety
communication systems.
Exceptions:

907.2.13.2 Fire department communication system.
Where a wired communication system is approved in lieu of an emergency responder radio coverage
system in accordance with Section 510, the wired fire department communication system shall be
designed and installed in accordance with NFPA 72 and shall operate between afire command center
complying with Section 508, elevators, elevator lobbies, emergency and standby power rooms, fire pump
rooms, areas of refuge and inside enclosed exit stairways. The fire department communication device
shall be provided at each floor level within the enclosed exit stairway.
1103.2 Emergency responder radio coverage in existing buildings.
Existing buildings that do not have approved radio coverage for emergency responders within the
building based upon the existing coverage levels of the public safety communication systems of the
jurisdiction at the exterior of the building, shall be equipped with such coverage according to one of the
following:
1. Whenever an existing wired communication system cannot be repaired or is being replaced, or
where not approved in accordance with Section 510.1, Exception 1.
2. Within a time frame established by the adopting authority.
Exception: Where it is determined by the fire code official that the radio coverage system is not
needed.

A. Adopted: The international fire code, 2006 edition, as published by the International Code
Council, Inc., and the 2006 NFPA life safety code, one copy of each which is on file in the
city clerk's office, is hereby adopted as the fire code of the city of Des Plaines. All of the
regulations, provisions, penalties, conditions and terms of said codes are hereby adopted and
made a part hereof as though fully set forth herein, with the additions, insertions, deletions
and changes, if any, prescribed below.
B. Fire Prevention Code: The international fire code, 2006 edition, is amended as follows:

installed or maintained in lieu of an approved radio coverage system.
2. Where it is determined by the fire code official that the radio coverage system is not
needed.
3. In facilities where emergency responder radio coverage is required and such systems.
components or equipment required could have a negative impact on the normal
operations of that facility, the fire code official shall have the authority to accept an
automatically activated emergency responder radio coverage system.
SECTION 2: If any paragraph, section, clause or provision of this Ordinance is held
invalid, the remainder shall continue in full force and effect without affecting the validity of the
remaining portions of the Ordinance.
SECTION 3: That the effective date of this ordinance shall be January 1, 2008. That
this Ordinance shall be published in pamphlet form according to law.

Re: 2010 Census — Change to Ward Boundaries
Issue: As the Council is aware, the 2010 census reveals new population data for Des Plaines and
requires the redrawing of the ward map to reflect federal court decisions on voting and
representative districts. At the August 20, 2012 Council meeting, the Council requested that
Staff review the proposed ward boundaries and make minor modifications. The proposed
second map reflects minor changes.
Analysis: The population of Des Plaines from the 2010 census is 58,364. This total population
figure divided by 8 wards is an average of 7,296 residents per ward. Most of the growth has
occurred in the first and seventh wards in the areas adjacent to the Union Pacific railroad tracks
on the north and south sides, and in new housing developments in the seventh ward. The map
was prepared trying to maintain current ward boundaries to the extent possible, using major
roads or railroads as dividing lines, and respecting neighborhoods, and precinct lines, to the
extent possible. Two precincts (10 and 19) which were split in the 2002 riap, are recombined 'n
the new proposed map. One precinct, the seventh, was split between the third and fifth ward to
bring the fifth ward closer to the 7,296 average. Precinct 11 was split between the first and
second wards. Three other split precincts, (E.G. 24, 9, and 48) remain partially split.
The number of new housing projects and condos in the first and seventh wards, with new
population, caused the geographic boundary lines for these two wards to shrink north towards the
railroad tracks. This caused the second, third, and fourth wards to move their boundary lines
north to pick up the territory and population lost by the first and seventh wards. The second
ward lost a portion of a neighborhood west of the Canadian National Railroad. The fifth and
eighth wards moved their northeast boundary lines slightly to pick up new areas to increase their
number of residents to be nearer the average. The sixth ward remains unchanged. The proposed
second map has the following figures:

For statistical comparison, 1% of the 7,296 average is 73 residents. 2% from the average is 146
residents. An average census block, as calculated by GIS, is 80 residents per block. However, in
the higher density areas of the City, the blocks were well over 100 residents, sometimes over 200
residents.
Summary of Changes — all references to precinct numbers are to Maine Township precinct
numbers unless otherwise noted:
First ward: The first ward lost a portion of precinct 10 south of the railroad tracks and precinct
11 south of Prairie. Precinct 9 had been split between the seventh and the first ward. A few
blocks of precinct 9 were shifted between the seventh ward the first ward to bring the numbers in
each ward closer to the average of 7,296. The balance of the ward remains unchanged.
Second ward: Due to the shift north of the first ward, the second ward picked up a part of
precinct 11, just south of Prairie. The balance of the ward remained the same, with the exception
of the loss of the western most part of precinct 48 that had been in the second ward to the third
ward.
Third ward: As previously noted, a part of precinct 48 and part of precinct 10, south of the
tracks, has shifted to the third ward. Now all of precinct 10 is in the third ward instead of being
split between the first and third wards. As a result of the growth in the north part of the City and
in order to allocate additional population to the eighth ward, the third ward lost a portion of Elk
Grove Township precinct 24. EG 24 had been split between the third and the eighth, but now the
eighth ward has a larger portion of E.G. 24. The third ward retains all of precinct E. G. 24 from
the north side of Walnut north to the south side of Dempster. The a portion of the east part of
precinct 7 which had been proposed to go to the fifth ward, was restored to the third ward.
Fourth ward: The fourth ward remained unchanged with the exception of a small part of
precinct 19 (formerly precinct 99 before the County changed the number) south of the tracks
which was in the seventh ward and now has been shifted to the fourth ward. Now all of new
precinct 19 is in the fourth ward instead of being split between the fourth and seventh wards. The
ward remains unchanged from the first proposed map.
Fifth ward: The fifth ward remains unchanged with the exception of the addition of a small
portion the northeast portion of precinct 7, added to bring the number in this ward closer to the
average of 7,296. The balance of the ward remains unchanged from the first proposed map.
Sixth ward: Due to some growth in the sixth ward, the boundary lines in the sixth ward remain
unchanged.

Seventh ward: As a result of the growth in this ward, it lost two areas south of the Union Pacific
Railroad tracks. It lost a portion of precinct 9 and gained back another small portion. The
precinct remains split between the first and seventh wards. The balance of the ward remains
unchanged.
Eighth ward: In order to pick up enough population to be near the average of 7,296, the eighth
ward picked up a larger portion of E.G. 24, which had been split and remains split between the
third ward and the eighth ward. The balance of the ward remains unchanged.
Recommendation: The proposed map has most wards numerically at or close to the 2% margin
from the average. Two split precincts are recombined. Two precincts are split, that were not
formerly split. Staff recommends that the City Council review and adopt the new second
proposed ward map. The first day that candidates can begin circulating petitions is September
25, 2012. The new map needs to be adopted prior to that date so that candidate packets can be
prepared for pickup by the candidates.

south along the west -east city limit line located approximately one thousand five hundred feet
(1,500') north of Golf Road to Western Avenue extended; thence south on Western Avenue
extended to the north line of the Cook County forest preserve property located just north of Golf
Road; thence west on said north line of that forest preserve property to the Canadian National
railroad; thence south approximately one thousand five hundred feet (1,500') along said railroad

Elmhurst Road; thence south and counterclockwise around said city limits to the point of
beginning.
1-11-2: INTERPRETATION OF WARD BOUNDARIES:
A. Any part of the city that has not been described as included in one of the wards described in
this chapter is included within the ward that: 1) is contiguous to the part; and 2) contains the
least population of all wards contiguous to the part according to the 2000 2010 decennial
census.
B. If any part of the city is described in this chapter as being in more than one ward, the part is
included within the ward that: 1) is one of the wards in which that part is listed in this
chapter; 2) is contiguous to that part; and 3) contains the least population according to the
2000 2010 decennial census.
C. If any part of the city: 1) is described in this chapter as being in one ward; and 2) is entirely
surrounded by another ward; the part shall be incorporated into the ward that surrounds the
part.
D. If any part of the city: 1) is described in this chapter as being in one ward; and 2) is not
contiguous to another part of the ward; the part included with the contiguous ward that
contains the least population according to the 2000 2010 decennial census.

SECTION 2: If any paragraph, section, clause or provision of this Ordinance is held
invalid, the remainder shall continue in full force and effect without affecting the validity of the
remaining portions of the Ordinance.
SECTION 3: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form according to law.
