CALL TO ORDERS The meeting was called to order by
Mayor Hobart M. Ahbe presiding with Aldermen Carroll, Johnson,
Pflughaupt, Henrich, Garland, Dopheide, Friatt, Schwanbeck,
and Campagna responding to the roll call. Alderman Lemke was
excused on account of illness.
REPORTS OF OFFICERS: The Clerk then read the report
for the month of January, 1938 of Charles M. Larson, City
Treasurer. Mayor Ahbe ordered this report placed on file.

read the following report: -
To the Chairman Is. Johnson, Judiciary & Assessment commi-
ttee, at the meeting of the City Council, held February 7,
1938, the following matter was referred to your committee:
The report submitted by H.A. Becker, Captain of Police,
reporting on a collision between the Police Squad Car and an
automobile owned by William Pierce of 1379 Oakwood Ave., Des
Plaines, I11.

The resolution for Section 4 -CS passed by
the City Council on January 24, 1938, was approved
today.
It provides for the improvement of approx-
imately 2590 feet of Arterial Street #2, White Street,
from Oakton Street to Howard Street, with an 18' bi-
tuminous surface, Sub -Class A-1, an a EC' water bound
macadam base.
The surface is to be built by contract and
the base by day labor, with an appropriation of
411,096.00 from the Motor Fuel Tax fund.

read the following proposed resolution:
RESOLUTION
WHEREAS, the City of Des Plaines desires to construct
a cement sidewalk across the right-of-way of the Chicago & North-
western Railroad in line with the Easterly sidewalk of Graceland
Avenue and
WHEREAS, the said railroad company through Charles P.
Megan, Trustee of Property of the said company has submitted an
agreement and specifications dated August 18, 1937, which agree-
ment and specifications are attached hereto and made a part
hereof,
LdEREFORE, be it that the City Council does hereby
approve the said agreement and that the Mayor and City Clerk be
and they are hereby authorized and directed to execute the said
agreement for and in the name of the City of Des Plaines.

LIMITING NUMBER OF LIQUOR LICENSES: The Clerk then read
the following proposed ordinance for second reading: -
AN ORDINANCE AMENDING AN ORDINANCE
ENTITLED "AN ORDINANCE REGULATING
THE SALE OF ALCOHOLIC LiquoRs IN
THE CITY OF DES PLAINES, COOK COUN-
TY, ILLINOIS, PASSED FEBRUARY 13,
1934, AS AMENDED.
BE IT ORDAINED by the City Cbuncil of the City of Des
Plaines, Cook County, Illinois:
SECTION 1. That Section 7 of an Ordinance entitled "An
Ordinance Regulating the Sale of Alcoholic Liquors in the City
of Des Plaines, Cook County, Illinois", passed February, 13, 1934,
as amended, be and the same is hereby amended to read as follows:
"Section 7. Limitation of Licenses. Not
more than fifteen retail liquor dealers'
licenses shall be issued and outstanding
in any one calendar year.
SECTION 2. All ordinances or parts of ordinances in conflict
herewith, are hereby repealed.
SECTION 3. This Ordinance shall be in full force and effect
from and after its passage and approval, according to law.

The motion was made by Alderman Dopheide and
seconded by Carroll to finally pass and adopt this proposed
ordinance. The Mayor put the question and the Clerk cal-
led the roll with the following result:- Ayes; Aldermen
Carroll, Johnson, Pflughaupt, Henrich, Garland, Dopheide,
Friott, Schwanbeck, and Campagna. Nays; one. The Mayor
thereupon declared the motion carried and the ordinance
passed.
DESIGNATING RANKS IN FIRE DEPARTMENT: The Clerk then
read for second reading an ordinance entitled:
"AN ORDINANCE AMENDING AN ORDINANCE
ENTITLED KAN ORDINANCE ESTABLISHING
THE FIRE DEPARTMENT OF THE CITY OF
DES PLAINES,K PASSED SEPT. 20, 1937."
The motion was made by Alderman uarland and seconded
by Schwanbeck to finally pass and adopt this proposed ordinance.
The Mayor put the question and the Clerk called the roll with
the following result: Ayes; Aldermen Carroll, Johnson, Pflughampt,
Henrich, Garland, Dopheide, Friott, Schwanbeck, and Campagna.
The Mayor thereupon declared the motion carried and the said
ordinance passed.
FIRE CAPTAIN & LIIMUTENABT TO BE APPOINTED : The
motion was made by Alderman Garland and seconded by Dopheide
that the Clerk write the Board of Fire and Police Commissioners
to appoint the Captain and the Lieutenant for the Fire Depart-
ment as soon as practicable. The motion was voted upon by
acclamation whereupon the Mayor declared the motion carried.

read the following letter: -

In re: New Traffic Code
Gentlemen:
I have carefully analyzed the new traffic
code submitted by the Safety Council, and it is sub-
stantially in order for passage except that there
are a few matters of information that I must be fur-
nished before the ordinance can be finally drafted,
and there are one or two sections that I believe the
City Council should definitely know are included in
the ordinance and upon which I wish to obtain the
Council's reaction before the ordinance is drafted.
The sections and subject matter in questionwe as fol-
lows:
(1) Section 48 of Article V of the proposed
ordinance refers to Schedule 1, and schedule 1 is to
contain the schedule of parking regulations. I do not
know what parking regulations the Council wishes to
adopt.
(2) Section 49 of Article V refers to schedule
2, which schedule is to contain information with re-
spect to parking limitations. I do not know what
hours of parking the Council has in mind.
(3) Section 50 of Article V refers to schedule
3, which is also to contain parking limitations. I do
not know what limitations the Council has in mind for
this schedule.

(4) Section 62 of Article VI refers to sched-
ule 4, which schedule is to contain a list of all
through streets. 1 should be furnished with complete
information on this subject.
(5) Section 64 of Article VI refers to schedule
5, which schedule is to list one way streets. I should
be informed whether the Council is considering estab-
lishing any one way street or alley in the Oity.
16) Section 65 of Article VI also refers to
schedule 5, which schedule is to contain those streets
that are to be designated as a boulevard, and I believe
that the Schedule referred to in Section 65 should not
be the same schedule as that referred to in Section 64.
(7) Section 69 of Article VI places in the City
Marshal, the authotity to grant or deny permits for
parades or processions on the City streets. Here-
to fore this power has been held by the Mayor and
the City Council. Is this new arrangement satisfac-
tory to the Council?
(8) Section 82 of Article VI refers to *Local
streets" and "Local intersedtions". I am questioning
this section and taking the matter up with the Safety
Council.
(9) Section 86 has to do with certain regulations
concerning railroad trains. I recommend that the fol-
lowing wording be omitted from the section "It shall
be unlawful for any railroad train or street car to
stop within an intersection or on a cross -walk for the
purpose of receiving or discharging passengers."
(10) Section 93 refers to registration of bi-
cycles. Does the Council wish to impose upon the City
Clerk, the extra work entailed in this section?
(11) I should be furnished with a complete
schedule of vehicle license fees, as charged by the
City of Des Plaines.

AUTHORIZING APPOINTMENT OF ONE ADDITIONAL PATROLMAN: The
Clerk then read the following proposed resolution: -
BE IT RESOLVED by the Qity Council of the City of
Des Plaines, Cook County, Illinois that the Board of Fire &
Police Commissioners appoint one additional patrolman to the
Police Department, in accordance with the rules and regula-
tions of the Board of Fire & Police Commissioners.
The motion was made by Alderman Carroll, and seconded
by Garland to adopt this proposed resoltition. The motion was
bated upon by acclamation whereupon the Mayor declared the motion
carried and the resolution adopted.
FORBIDDING USE OF FIREARMS: Alderman Garland then in-
troduced the following proposed ordinance which was read by the
Clerk for first reading:-

LING AND TRAPPING OF BIRDS AND
ANIMALS IN THE CITY OF DES PLAINES.
BE IT ORDAINED by the City Council of the City
of Des Plaines, Cook County, Illinois;
SECTION 1. It shall be unlawful for any person to
fire or discharge any gun, pistol, or other firearm within
the City of Des Plaines except upon premises used by a shoot-
ing gallery, rifle club, gun club, or rifle ar revolver
range, for which a permit has been granted by the City Council.
SECTION 2. It shall be unlawful for any person to
kill or shoot at any animal, bird or fowl within the City of
Des Plaines with any firearm, sling -shot, air -rifle, so
called "Bee -Bee" gun, or other deV*ices.
SECTION 3. It shall be unlawful for any person to
trap or attempt to trap or snare any animal, bird, ar towl
within the City of Des Plaines.

in full for second reading a proposed ordinance entitled:

The motion was made by Alderman Pflughaupt and secon-
ded by Carroll to finally pass and adopt this proposed ordin-

Mayor Hobart ii. Ahbe then signed the said ordinance
in approval thereof and Edgar J. Friedrich, City Clerk attested
the approval.
The motion was then made by Alderman Carroll and se-
conded by Dopheide to instruct the Clerk to cause this ordin-
ance to be published in the *Des Plaines Suburban limes". The
motion was voted upon by acclamation whereupon the Mayor de-
clared the motion carried.
VALEREEN CO. TO COMPLY WITH LIQUOR ORDINANCE: Alder-
man Dopheide reported that the Walgreen Drug Btore has apolo-
getically agreed to arrange their store so as not to violate
the City Liquor Ordinance by keeping the store open on Sunday
mornings. The motion was made by Alderman Dopheide, and se-
conded by Carroll to refer this matter to the Liquor Control
Commission and the -uuilding Inspector. The motion was voted
upon by acclamation whereupon the Mayor declared the motion
carried.
OLD RIU,RVIEW TOWN HALL: Alderman Johnson Chairman
of the Judiciary & Assessment committee reported that in as
much as Riverview now has a new school and will no longer
occupy the Riverview Town Hall, the city will now have to pay
for the insurance on the building if it is to be insured. He
also suggested that the City might wish to dispose of the prop-
erty t Mayor Ahbe referred this matter to the Committee on
Public Works, Luildings, and Plats.
SUGGEST WIDENING OF EMMY AVENUE: Alderman iienrich
inquired as to the possibility of widening .eeney Avenue, stating
that traffic conditions seem to indicate the need for widening.
Mayor Ahbe referred this matter to the Streets & Sidewalks
Committee.
VEHICLE LICENSE DISCOUNT DEADLINE: The motion was
made by Alderman Carroll and seconded by Garland to instruct
the City Attorney to prepare and submit to the Council at this
meeting an ordinance extending the discount date of 1938 ve-
hicle licenses. The Mayor put the question and the Clerk cal-
led the roll with the following result: Ayes; Aldermen Carroll,
Johnson, Garland, Dopheide, Friott, and Schwanbeck. Nays;
Aldermen Pflughaupt, Henrich, and Campagna. The Mayor thereupon
declared the motion carried.
After a few minutes the following proposed ordinance
was submitted by Kenneth G. Meyer, City Attorney and read by
the Clerk for first reading:

BE IT ORDAINED by the City Council of the City
of Des Plaines,
SECTION 1. That for the year 1938 the reg-
istration fees of Motor Vehicles shall be as follows:
Up to and including March 31st 1938 - 4 3.00
far Vehicles having a horsepower of 35 and under.
$6.00 for Vehicles having a horsepower of over 35.
After March 31st 1938 said Vehicle licenses
shall be $5.00 for vehicles having a horse power
of 35 or under. 48.00 for vehicles having a horse-
power of over 35.
This ordinance shall be in full force and
effect from and after its passage and approval according
to law.
The motion was made by Alderman.Carroll and seconded
by Garland to suspend the rules to permit the passage of this
proposed ordinance at this meeting and place the same on pas-
sage. The Mayor put the question and the Clerk called the
roll with the following result: Ayes; Aldermen Carroll, John-
son, Garland, Dopheide, Friott, and Schwanbeck. Nays; Aldermen
Pflughaupt, Henrich, and Campagna. There being a two-thirds
vote of the entire Council required to suspend the rules, the
Mayor declared the motion lost and ordered the proposed ordin-
ance filed for second reading.
PILLING STATION ORDINANCE: Kenneth G. Meyer, City
Attorney then,stated. that there has been handed to him a draft
of a proposed ordinance controlling filling stationsin the
city, and suggested that it be studied by a council committee
before introducing the same for first reading. Mayor Ahbe
referred the said draft to the committee on Public works,
Buildings, and Plate for study and report.
APPROVAL OF BILLS: Alderman Pflughaupt, chairman
of the Finance Committee then introduced a resolution approving
bills and salaries for payment. The motion was made by Alder-
man Pflughaupt and seconded by Garland to adopt this proposed
resolution. ,However a motion was made by Alderman Carroll and
seconded by L/chwanbeck to amend the resolution by striking
therefrom the item qtdgar I. Friedrich, back salary as City Clerk
$1,800.009. The motion to amend was voted upan by acclamation
whereupon the Mayor declared the motion to amend carried and
the said item strikenfrom the resolution. The Mayor then put
the question an the motion to adopt the resolution as amended
and reading:

APPROVAL OF MINUTES: Each member of the Council
having at hand a copy Q the minutes of the regular Council
meeting held February 7, 1938, the motion was made by Alderman
Carroll and seconded by Dopheide to approve the said minutes
as written. The motion was voted upon by acclamation whereupon
the Mayor declared the motion carried.
DRAINAGE IN FRONT OF GEISEIPS GARAGE: Upon the request
of Alderman Johnson Mayor Ahbe referred the matter of faulty
drainage in front of Geisen's Garage to the Streets & Sidewalks
Committee.
MONTHLY REPORT OF CITY TREASURER: Alderman Henrich
insisted that the City Treasurerts reports are in-
complete and demanded that the Treasurer submit monthly re-
ports as prescribed in the statutes as well as in the City
Ordinances.
MEET AS COMMITTEE -OF -THE -WHOLE: Mayor Ahbe then
`called a meeting of the council as a committee -of -the -whole
for Monday evening, February 28, 1938 to discuss several
proposed ordinances.
ADJOURNMENT: The motion was made by Alderman Schwan -
'beck and seconded by Johnson that the council adjourn. The
motion was voted upon by acclamation whereupon the Mayor de-
clared the motion carried and the council regularly adourned.
